OFT announces decision and next steps on bank charges

      144/09 22 December 2009
Following the Supreme Court's judgment last month...........

      Well - that's that then.

I cannot help being cynical about all of this - a Treasury official takes over for a year at the OFT (let's face it - part of the government) [I wonder how many of us bothered to look at that PDF file posted up where it showed him to be a signatory on the treasury purchase of all those lovely RBS shares.....] and within a few months we are all kicked in the teeth for Christmas.

The worst thing about this is feeling helpless - even as one who managed a successful claim (as I've said before, I count myself as one of the lucky ones) - we all know this is monumentally unfair, but cannot now do anything about it. How do we reconcile (especially those who have never had a successful claim) the fact that so much money has already been paid back as a 'good will gesture' ? Mind-boggling.

Market sensitive ? What about consumer sensitive ? Why was this left until so late in the day ? What about the consumers with stays in place which state "28 days from the date of the test case decision....etc, etc....." so presumably today is their last chance ! The timing certainly has a morbidly elegant ring to it. (No - perhaps elegant is not the word I'm looking for.....)

I know that the team on here have worked tirelessly and they, above all, must now feel really let down and horrifically disappointed by this decision by the OFT - it seems as if they and we have been pushed right down a blind alley.

I feel extremely despondent about this decision and will wait for advice from the superb and knowledgeable moderators on this forum. I just can't help feeling that we really are well and truly dead in the water now.

What a blow - this simply confirms what I have thought for a long time now - that this system is absolutely rotten to the very core.

I imagine that one of my last bits of post this year will be my 'Christmas Card' from NatWest informing me that after careful consideration of my case and following the recent decision.... blah, blah.... they will now be closing their investigation and their lawyers will be applying to have my claim struck out.

Bankers will literally be "smiling all the way to the bank" today.....

      Happy Christmas !
(I genuinely mean that last bit - to one and all of you on here)

Keep the faith Not_Watson, it's not over by a long shot and the Supreme Court judgement was always a risk given the way the OFT ended up angling their arguments.

It's not a huge conspiracy though - even though I grant you, it looks like one of the better ones in recent years.

              Hey All

Well I have to say Im glad we have a decision one way or the other, now everyone can move forward, and get their 'balls' rolling.

Not a great decision, but its still a place to start. Onwards and upwards!

                Quote from mse

                "
Martin Lewis, MoneySavingExpert.com creator, says: "The OFT told me this morning they looked at taking the case forward under the CCA.
"But because it is about the relationship between individual and lender, it felt it was not appropriate to take it on as it thought individuals taking action would have a greater chance of success.
                ---------------------------------------------------------------------------------------------------------------

If this is true them surley the oft dropping the case was actually a CLEVER move from them as they full well know the new complaints brought by customers will inevitabley land on there door step anyway so them dropping the case has done us all a favour.

I feel there would be no chance of any success having to take the bamsk on ourselfs I feel a bit cheated now and the banks will be laughing at use, I hope they enjoy their bonuses. where is the justice...?? I know a lot of you will say its not the end of the line etc, but lets face it we won't win individual cases now even if you belive that to be true.
However downhearted I or anyone else is I still do not take away all the hard work you guys have put in Great effort on your part And i just hope you don't feel to downhearted about it all as your the ones that have done all the hard work!!
                  thanks Dudes!

There is a mistake, albeit minor, on the OFT announcement..(on the OFT website)
So, for a bit of fun, can you tell me where it is(I'll post it up in an hour if no eagle eyed beagle gets it)?

That they made us think they were working for us, and that they could make a difference!

The Supreme Court on 27 November overturned these previous judgments.

Think they have their dates wrong!
