                Well this is a real stab in the dark but it may be that his QC knows a bit about the need to refrain from disclosing sensitive information. But it's only a guess mind.

                  To be fair the OFT didnt say it has to stay confidential just that its market sensitive. They didnt tell us untill after close of trading today for a reason, even tho sarah mccarthy let the cat out the bag on wednesday as to the 22nd being the date.
                  I also think we acted correctly not diclosing the time of the announcement without checking first as that part seems quite important and has been subject of much discussion between government, fsa, oft etc.

                      To be clear when the OFT informed us of the date we asked, amongst other things, if the date was embargoed. In further communication they didn't respond to our embargo query and we didn't want to hassle them further about it.

                      Not being absolutely sure we decided to err on the side of caution and not disclose it until someone else made it public. And that's exactly what we did.

                            Under CCA s.140 arguments does the same rule as UTCCR 1999 still apply ie term is unenforceable in its entirety?

                              Not to get ahead of myself but If the OFT decide not to act again what would this lead to....Im suuuure you have a little clue as to which way they are swaying...;p?

                                well prob mse getting new template letters out everyone claiming the banks not knowing what to do going to the oft and then a new test case so really the oft should continue as they are going to be forced to at some point of another.
