I am posting to this thread as I really need some advice on what to do and where to go from here. My company got a mortgage with Lancashire mortgage back in Feb 2011. At the time I did not have a choice as we were 9 months old with no accounts. So I raised 40% through a personal re-mortgage and my business went through Lancashire Mortgage for the remaining 60%. It is an interest only loan at a crazy 12%, like I said at the time I felt like I had no choice.
Good news we are now in a position to go with a mainstream lender, but I may have hit a few issues with this company. The big one being is they have not sent me an annual statement in the whole time I have had this mortgage. I pay at the end of the month every month without fail using the company debit card. This came about as there was an initial problem with the DD so I cancelled it and tried to set up a new one through LM. They used the same reference number so my bank rejected it, I missed a payment without knowing, back in 2011. They were very quick to let me know, I paid the total owing and tried to set up a DD again with them, they sent me the DD guarantee. This time I keep a close eye on it realised it hadn't gone out, paid by debit card and contacted my bank. They explained about rejecting it because of the same reference number. So I got in touch with LM again and well not helpful is the best way of describing it. So I started paying by debit card. They are not happy with this and say I am in arrears every month despite me never missing a monthly payment. They write to me every month saying I am in arrears and ring when I am working leaving voice-mails telling me to contact them, I do not understand how I can be in arrears when I pay every month?
I am now concerned that they are adding unknown charges to my account (with interest of 12% its rather unnerving) and with me never being sent a statement I have no idea where I stand or what is owed.
Is it legal for me not to receive an annual statement from them and for them to say I am in arrears every month despite me never missing a payment?
