        This morning I looked at their Terms & Conditions which were 'revised' on 31st January this year. (I was checking to see whether their 'revision' complied with the ASA's recommendations). I imagine the most significant revision is the fact that the products can now be returned to Stephen and Greta who inhabit the warehouse in Rugby, rather than being returned so somewhere in the Middle East.
        As you're all probably aware, they are several pages long: so I haven't waded through all of them: but 'number 4' caught my attention! How dubious is this?

        I think this one definitely flouts the law pertaining to 'unfair contracts' ... !

          terms in contracts with consumers.


          Standard terms are those devised by a
          business in advance, not individually negotiated
          with the consumer. They do not have to be in
          writing but typically they are found in the 'small
          print' on the back of order forms and bills and
          so on. While the Regulations do not apply to
          any term that can be shown to have been
          individually negotiated, they do apply to any
          standard terms in the same contract.


          ... but again, unfortunately, the enforcers of this regulation are Trading Standards Officers!

            Just by luck my cousin called me today from Israel and she said if I send her all the details and the PO box in Israel she has ways and means to find out who is behind it.

            She is a bank manager and can delve right into the company. It is a holiday there this week but she has promised when back at work she will do all she can to get as much info as possble for you all. She said it sounded like a fraud - and she will do her upmost to find out what is going on there. She is nowhere near Ceasarea but she has access to all the information she will need.

                Just a thought, It might be worthwhile to those who got caught out first time to send the emails that I sent too so that you get the emails back saying you are not subscribed & no more charges will be made to your card....It is because of these emails that I am covered under the visa guarantee according to my bank.

                Once you have that & have spoken to your bank about it, you are all set up to have everything refunded to you if they do attempt to go for money.....which we know they do as they have sent me more of the stuff 2 months later without me ordering it! My bank seem to think they will do this a few times as they have done it to others.

                I know it doesn't get the original money back but it does protect you from losing anymore to them!

                    I ordered what was presented as a limited free trial of two products by this company. When £174 was taken from my account, I called my bank. I went back to the Dead Sea Beauty Kit and Collagenta terms and conditions and found their money back guarantee. In the meantime I reported this company to the Advertising Standards Authority and Citizen's Advice Bureau (the only port of call for what was the Trading Standards).

                    At the further cost of £17.45 I posted the products back to the address given in Israel.

                    However, I also:
                    Went to both websites, logged in and switched off the Auto-Ship or Auto-Renew. I wrote to them from each website while logged in saying I was cancelling and returning the products.

                    I also posted a letter to their head office. Then I tried the phone number which welcomes you and leads you to a dead line.
                    There was an email address in terms and conditions, which I wrote to.

                    I get this email:
                    Please give us a tracking ID as proof of return and we will refund your charge.
                    If you cannot provide us with a tracking ID, please sent a picture of the receipt to alex@deadseakit.com , victoria@deadseakit.com , stephen@deadseakit.com or jane@deadseakit.com

                    If you cannot provide us with proof of return We will issue a full refund for the charge to you, once we receive your returned product.

                    I send in my receipts.

                    A few weeks later I get a text informing me that a payment has been made on my card in Mauritius and to call if suspicious. I call the bank and find it is DS Marketing trying to take £69.95 from my account from Mauritius. Two previous calls said that under 2 different names, DS Marketing had tried and failed to take money from my account as Defying Age and Collagenta. They used a new name Hautcollagen.

                    I emailed (promise of reply within 24 hours). 72 hours later I get a reply.

                    Two more shipments arrived. I had changed Auto-ship and Auto-renew to none on both websites, and they had changed them back to monthly. They even put 'not recommended' by the off option.

                    What's this Tessy writes about convenience? For my convenience? Oh, very convenient that I had lost days of work, read all their terms and conditions, found my original emails, logged into both websites, written through their weedy 'support' or 'contact' form to say I'm returning the products, emailed them, reported them to all and sundry. For my conveeeeeenience that I'd packed the products up, walked to my post office and spent a further £17.45 sending them back. Then more convenience, aren't I lucky, that the refund doesn't arrive, so I have to email proof of postage and then get my refund. So for my utter convenience, that I have to call the bank 3 times and am totally distracted from my work, life and deadlines to deal with a company that has CHANGED THE AUTO-SHIP AND AUTO-RENEW in my account back to monthly!!!!! aw geeeee. So conveeeeeeeeeenient.

                    I went back onto each website with my login, and wrote to them again. I wrote back by email listing all the ways I had contacted them and that I had had a refund and received confirmation from someone called Alex that I would not hear more from them. I found that the Auto-ship and Auto-renewed had been changed back to monthly.

                    Yes, after sending back products, receiving confirmation of no more shipments or charges, I am charged more and sent more products because someone has gone onto the website and changed my 'subscriptions' or whatever back to monthly.

                    Under 'my cart' it even says nothing has been ordered. I checked every inch of those websites.

                    These people should be jailed.

                      sophsweet, you're absolutely right ... these people ought to be jailed.

                      I'm sorry to say that yours has got to be the worst case that I've read so far ... whereas my own case involved 'trickery', and misleading advertising by DS Marketing Ltd; your case involves blatant fraud. Personally, I'd report them to the police.

                      Did you get any joy from the C.A.B?

                      NB: Perhaps you should remove your personal details from the attachment?

                              Probably not CC, but will sure try and find the culprits. But they are linked to scaming folk into believing the samples are free.

                              Has anyone by any chance ever gone to the advertsing standards to complain about this scam?

                                Yes TUTTSI, the ASA adjudication is here: http://asa.org.uk/Rulings/Adjudicati...DJ_202609.aspx

                                This was last November, and as a result DS Marketing 'tweeked' their advert very slightly ... they removed the Union Jack flag!!! But unfortunately they simply ignored the other instructions from the ASA.
