    I forgot to say that the latest parcel is from Tfs - the only clue on the packaging was an account number on the label from the delivery company DPD. I emailed them & asked who it was.

      Hi all,

      I think that I would caution against simply being assured by the credit card company, unless they are prepared to confirm by email. They are not solicitors, and may well not have experience of contract law. Some time ago, I joined a book club, and got sent a book I did not want. There was a default setting (which can be the case with auto refills in our type of cases) which meant if I did nothing, I got a book. I could return it, at my own expense. However, I did find out that if you do receive something you genuinely did not order with the suggestion you will be charged, I was told I should write to the company and say that if they don't send a return postage label, then I am entitled to keep the goods, free of charge.

      In your case Shas, I would email deadsea and advise that you require a return label, as you didn't order the product. They may just, do this, or they may forward some terms and conditions you inadvertently signed up to. You are though putting deadsea on notice of what you consider the position to be.

      Like Zed, you may well be speaking to a sympathetic advisor, but then find that Visa over rule this.

      When I first spoke to Lloyds, they were understanding. The second person I spoke to was adamant that it was not fraud and I should have read the terms and conditions, so there was no chance of me getting my money back.

      Anyone spot the difference between Mary/Kristen? I haven't managed to yet.

      Also if you look at the offer deadline, and track this, together with the user comments, you will see that they auto update. At midnight, the date changes for the offer, and for all of the feedback comments. This really is completely misrepresenting the position.

      I also tried clicking on the links at the top, under the 'magazine' title - guess what - they go know where.

      I am going to speak to my bank again tomorrow. I heard something very useful on the Ripp-Off Britain programme the other night.

      'If you are induced to enter into a contract because of misrepresentation, you are in a very strong position to challenge the transaction.'

      I don't believe there is a time limit, (other than the six years statute of limitations) in which you can make the claim, but you need to demonstrate the misrepresentation. I am taking screen prints of what deadsea and the other product suppliers are doing, and would suggest that anyone else who has just got ripped off by these people do the same. This is your evidence of misrepresentation. I have one that states 'Receive a free 30 day supply of Dead Sea Kit', this is in clear contradiction of the fact that they always intended to charge for the products.

This is exactly the point that I made to Santander when I sent them a copy of the ASA's adjudication concerning the misleading content in DS Marketing's online advertisement ... but Santander took no notice. Perhaps those of us who have had no co-operation from our banks/credit card companies should refer the matter of misrepresentation to the FSA?
        (Trading Standards would appear to be the most obvious people to tackle the issue of misrepresentation ... but unfortunately they're simply not interested).

        I'm personally still keen to pursue the matter of DS Marketing Ltd's ongoing breach of the cosmetic labelling regulations ... but again: I can't find anyone in a 'position of authority' who is willing to prosecute them.

          These are both dated January & then on Friday...2 months later, out of nowhere, a small white envelope with another bottle of collagenta is posted to me! I definately didn't order it! There's no paperwork, just a minute sender account number on the address label.

          The bank says that I am covered under the visa guarantee so will get refunded immediately if any money leaves my account.


          I will wait until the charge drops off my bank account before calling them about it. That should be sometime next week....

              Certainly seems that you are more than covered on this one, and that Deadsea can't take any money.

              Zed, I want to find out more about the legal position of the bank. By the bank refusing to accept that the payments to deadsea were obtained by deception at best, blatant fraud at worst, I can't help but think that they have breached some code somewhere. By not allowing you (or me) to claim that the payments were obtained by false inducement, they are, to my mind acting as solicitors, and making a judgement on the legality of an agreement without full information.

              They should, at least, hold the payment and allow us to submit all of the information that is available about this company.

                I have just checked my bank & their application for money has now gone off the system.... i.e.: my available funds have gone up by approx £70.

                So now, I am left with their product & they haven't got any money.

                If it happens again, I will get my bank overdraft upped again to cover the amount of what they try to get until the charge drops....like this time so that I am not affected in the pocket by them.

                Hopefully they will get the message & stop sending me their products!

                  Yes, I agree absolutely scubakay. I think I'll pop into the CAB this coming week ... the situation will probably be beyond the scope of the work that the volunteers take on: but at least I'll get a referral to one of the solicitors that they liaise with. (I could probably get to see any solicitor under the 1/2-hour free Legal Aid consultation scheme ... but if I opt for a CAB referral instead, I'll get a longer appointment than the 1/2-hour!)


                  Shas ... that Greta character is one of the staff based in the distribution centre in Rugby. They claim to be merely a 'logistics' firm ... so it's a tad strange that they should be replying to emails sent to DS Marketing! (Could be just a coincidence, I guess: both firms hire a member of staff called Greta ... not very likely though!!!)

                      Just out of interest ... have you used any of the products shas? I've seen comments on other forums were people have reported getting bad skin/eye reactions to them. In fact, there was a suggestion that when the products are returned, DS Marketing simply despatch them to another unwitting customer ... certainly the 3 pots that I received appeared to be 1/2-empty!

                        I didn't dare use them when I saw they had no ingredients on them...or instructions!

                        Im a qualified beauty therapist & this rang alarm bells, as it should to anybody!
