                Ok looks like a fairly good reconstituted agreement.
                So Now we need you to confirm that the debt is statute barred.

                Statute Barred in England & Wales = 6 clear years with no payments or written acknowledgment mad to the debt;
                For debts founded on simple contract (credit cards/unsecured loans) the 6 year clock starts ticking on the date a contractual payment
                was due and not made after which no further payment or written acknowledgment was ever made.

                  Yes i done a sar request and i worked it out on that it was 6 years on 4 th march 2015 (last payment made)

                  My noodle credit report had the default date as 6 years was up on 4th april 2015

                  i have made no payments or contact since then.

                  It has also dropped of my credit report last saturday! it no longer shows.

                  They have give me 14 days to reply so if I reply after the 4th of April
                  It after the time my credit report had it stat barred

                    No time for the stat barred letter.

                    I refer you to recent correspondence regarding and alleged debt for £xxx.xx which Arrow Global Claims is owed by me, please take not I do not acknowledge and debt to Arrow Global.

                    I have researched my credit history and have concluded that any such alleged debt is Statute Barred under the provisions of the Limitation Act 1980.

                    Therefore I will not make any payment in regard to the alleged debt.

                    I suggest Blake Lapthorne now closes the file on this matter and returns it to its client.

                    Blake Lapthorne will confirm in writing within 7 days that this matter is closed.

                    Uses signed for post, check delivery date.

                          These shi*s have now sent me the letter attached ?

                          i have never made a £1 payment and why would i pay £1 ?
                          only thing i can think of is they are trying to say it was £1 i sent as a postal order for cca request,
                          which stated in the letter not to be used for anything else ( not sure of dates i sent cca request as not got the paper work )

                          The sar report says last payment was 6/1/2009

                          my credit report had it as stat barred 4/4/2015

                          It has now dropped of my credit report.


                          Are these just trying there luck now? what should next step be

                              should i just type a letter out asking the above and send recorded.

                              1: if i did send a cca request at that time is it possible they have used the £1 postal order for the cca request to make a
                              payment of the account instead ? is that legal when the cca request says its solely to be used for the cca only.

                              2: Are they likely to still issue court proceddings even though i know i have never made a payment on the account.

                                Hello Jay,
                                Can you recall who the account was with in 2011?

                                My thought is to tell BL that the £1.00 alleged payment would be for a lawful request for the provision of documents under sections 77/78/79 of the Consumer Credit Act 1974 and it does no affect the Limitation period.
                                I would also state that: " I am well aware of the practice of some debt purchasers and debt collection agencies allocating statutory fees
                                for request to the debt account in order to reset the 6 year clock.

                                I maintain my stance that the alleged debt is statute barred and I will not be paying.
                                The onus of providing unequivocal proof that the alleged debt is not statute barred falls entirely upon your client, unsupported claims of a one off payment is insufficient proof.
                                I suggest that BL advises its client to withdraw claim in the interest of saving costs and court time.
