        It looks exactly the same to me! I've read the thread but this is a little bit over my head... prob cos the charge on my house make it emotionally loaded... are you telling me the agreement is unenforceable? (I dont want to get too excited lol) & shall I email the charging order relating to it to you?...

          Thanks for that.
          Problem here is the amount of time that's passed, 18 months.
          Normally when contesting a CCJ/CO time is of the essence.
          The good thing is there's no further interest being charged.

          If you are looking at a set aside then we need as many TP's as possible.

            Hang on, Im not familiar with what a set aside or tp is???

            The dmc told me at the time that it was just a formality (the co) in order for my payment plan to be agreed to & nothing to worry about. I went to court & got the extra bit in brackets added to the order. The judges for the other orders wouldnt add it in theres...

              Set Aside - Basically stops or holds action.

              TP's - Tw*t Points, mistake the other side have made that need to be drawn to the courts attention. In this case all of the errors on the loan agreement.

              There's also the issue of possible further costs due to the values involved.

                ***BREAKIMG NEWS*** I have just received a list of the outstanding balances which I requested for Amethyst on page 1. Apparently several of the creditors have made offers on reducing the balances & I need to ring the office..... should I tell them anything?

                    I have rang....

                    Basically UCA have said that if I pay them an extra £5 a month they will freeze interest... which is tempting! Uca havent replied to my cca letter yet either...

                    MARLIN... told the dmc yesterday that my o/s bal was £12334.81 yet when they wrote to me on the 15/7, my balance was £10941.41. Im wondering why theyve put that many charges on (what is supposed to be a frozen a/c) within a week.....

                      Hi Shas,

                      Write a letter to Marlin, ask for a breakdown of all of the £12334.81 they say you owe. If it is made up of charges ask for them back as they are bound to be unlawful.
                      Borrow money from a pessimist -- they don't expect it back.

                        Marlin have now passed over to mortimer clark solicitors....

                        They now say that because the debt is secured they can charge interest....im having a bit of a panic....

                        Even if I pay them the agreed amount for 53 years.... im still going to owe them over 50k.... the balance was 8k to start with........

                          You still want a breakdown of all charges on the account by Marlin, so you can reclaim them. Marlin have obviously passed this onto their solicitors to intimidate you. Write to Marlin and let them know you will not be intimidated by their tactics and want a freeze and breakdown of the account under the 'subject access request' then any "charges/penalties" they have imposed can be tackled as unlawful and reclaimed.
