    The council need reminding that the bailiffs are actually employed by the Council, and as such the council CAN tell the bailiffs what to do, and can instruct them to accept a certain payment plan.

    Have you sent a SAR to the bailiffs and got a breakdown of charges applied to this debt?

    Equita are notoriously crap, but they can be dealt with. Send an SAR request to them - you'll probably never get a reply but at least you can use that fact as ammunition. Also email their complaints department, I did have the email address but I think I've dleted the email i sent them, can't find it anywhere. Anyway, when i did it i got a reply within a couple of days and ended up getting all the charges removed, although this was for my mate's C Tax debt, not a parking fine.

      I have sent a SAR to them and have up to now had no reply.

      Ive just emailed the lady from the council again telling her what you said about them employing the bailiffs so I will wait and see what she replies!

                Just a quick update, after all the help you've given me I don't want you to think I've just disappeared without a word.

                Well after Trading Standards contacted me the 'phone calls from Philips have stopped. Don't know if it's related but it's a relief in itself. Not had any more letters either so it just a case of wait and see I suppose.

                  I've got the Bailiffs after me - Long story, but anyway - I know you're worried natant24, so here's an example of a typical ' Scare Tactic' - I got a letter in the post the other week from them, it basically said that they were after my car ( I'm self employed and my car is on HP ) They've given up trying to gain access to my house for now, because they've had to ( Long story ).. Anyhow, at the top of the letter was a crappy little copied/pasted stock photo of a small white van with a CCTV camera on the roof - And the letter advised me not to use my car on a public road, because if I am spotted by the small white van with the camera on the roof - ( which according to them - Circles the area all the time ) - They will clamp the car and take it away.

                  Bailiffs will lie in order to get what they want - Like the people say on here - My advice is: Follow what's been said on here..Stop stressing ( that makes it worse, trust me ) - Bailiffs also have very limited powers, so it's up to you to stay ahead of the game with them. Research it as much as you can - The internet holds loads of info on what to do/Your rights/Their limited powers etc.. I know it's hard, and sometimes it all seems a tad unnecessesary but believe me - If you can stay on top of it, and follow the advice you are been given on here, plus CAB and any other research you can do - You might just find that you swing it your way.

                    Its ok its good to keep up with everyone and seeing their situations hopefully improving.

                    I have still yet to hear from Equita about my SAR, and up to now they have not cashed the cheque either. Their 40 days isnt up for a while though so i will keep you all posted.

                      Thanks tourbus. I am a bit less stressed now after reading up mainly on here and following Amy's sound advice. The council tax bill has been returned to the council it is just my parking fine now which im trying to deal with. If he turns up again he will find a locked up house whether im in or not!! And he will have a job finding my car too!!!!

                        Yeah I meant to mention earlier - Stash the car!!

                        When I did my SAR, they took forever to reply and when they did eventually reply to me, the excuse was ' Sorry for delay in replying...Your letter was incorrectly mis-filed' Yeah I bet it was!! Another thing - Make sure the Bailiff/s in question have/had a current VALID Bailiff Certificate in place - You can check this here - http://www.hmcourts-service.gov.uk/C...catedBailiffs/ and I would recommend searching by company name first, then scrolling down the list. If you are in doubt, give the HMCS a call, and they'll clarify. I've been through it all I know it's a pain in the bum but keep at it

                          Sorry havent been in touch lately guys, things have been a bit crazy!!

                          40 days has came and went without a reply, what do I do now?????

                          And, someone came and clamped my car for the briefest of seconds it was outside my house they got me and I had to borrow £377 to pay him off!!!!

                          I now owe my lovely younger brother this money and I hate borrowing from family!!!

                            You badly need the SAR information and since their time is up, send them one reminder and then sue them, but as always, don't write it if you don't mean it.

                            On (date you wrote the SAR) I sent a formal Subject Access Request and included the statutory maximum fee of £10, according to the above Act, which was received by your office on *********.

                            I have attached a copy of my original letter of (date you wrote the SAR) for your convenience and would suggest that you attend to my request as a matter of urgency.

                            This letter has been sent by first class post and therefore should have reached you by (calculate the date) and the date of receipt will be indicated by Royal Mail's service audit. I have no doubt that you will be aware, as of this date your statutory 40 days for compliance expired on (date it expired).

                            I am prepared to accept that the lack of information sent thus far is a genuine oversight on your part and, therefore, I am prepared to give you a further seven days in which to comply.

                            However, should this deadline expire without receipt of the information that I have requested, I will be left with no alternative but to commence a County Court action under s.7 and s.15(2) of the Data Protection Act 1998 when I shall seek a Court order obliging you to comply together with damages at the discretion of the Court and without further notice to you.

                            Furthermore I will escalate this matter into an official complaint to the Information Commissioner.

                                As Amy said earlier, don't write to them if you don't mean it!

                                Paragraph 5 of your own letter:

                                It's time to sue them, they have breached the Data Protection Act by not complying with your SAR.

                                They won't be expecting to get sued, they probably get quite a few letters like this and continue to treat people with contempt.

                                You sound bright, determined and motivated. Fancy getting back at them now they've given you perfect grounds!?
