In a way stage 2 litigation isn't needed in the scenario that the OFT come out and say the charges are unfair and as an authority that has the power to enforce UTCCR it's view stands until it is challenged in court.
I very much hope there is a stage 2 as it will make a nonsense of the whole concept of a 'test case in order to provide legal clarity and certainty'.
But even If the OFT don't partake in a stage 2 then it is beyond doubt that someone else will, in the form of a Representitive Action.
