Parking Control Management/Gladstones Court Claim

    Not sure what the forbidding bit means but I would go on the signage is not adequate and it said to park in a numbered bay you need a permit. The car was not in a numbered bay?

      Also if the claimant starts when do I pipe in that their case is all shitty without even getting to the parking issue? Because they're gonna pipe up about the parking aren't they x

        Okay so so far in my folders I have my witness statement ha! Should I put my defense in too? Any of their rubbish in there? And am I presenting them and the judge with a folder each?

        So I come in and what happens? I'm just trying to work out when I would say anything about their failures. Does the judge start by reviewing what he can see? Like the POC and the defense etc?

        I'm struggling with these cases links too. When would I hand them over? And what am I pointing to?

          Okay I'm pretty much there. I just need to know what to put in the other two folders like their documents too or not. Also is Philpot expected to be there? Like if they send local Joe to present their case is that too unreasonable? And dishing out the other cases isn't presenting evidence not already filed is it?

              Also by object can I just when they're talking say I object or disagree or will I get a chance to speak after each piece of evidence etc

                The £100 is said to be a contractual penalty. In many cases there are contracts created because tehy offer parking based on what they say and by parking these terms are accepted. However, in this case, there is no offer to park to people without a permit. You are forbidden to park. Quite clearly you cannot contract with someone not to do something.

                Right away. Relevance is a key thing. Excuse me, what relevance does that have to the pleaded case ?

                All the stuff you sent them and they sent you. Defense isn't required but put it in too. Put the cases in too. The judge will introduce everyone and then direct from there. Cases in the files and then ask the judge to each one as and when required. Point to the bits that agree with what you are saying. So the pleadings are shit you'd say something like - In Hawksworth v Chief Constable of Staffordshire & Anor [2012] EWCA Civ 293 (16 February 2012) which is number 548564 in the folder, Lord Justice Tomlinson at para 40 said ..........

                It's unreasonable to not have the witness when we have written and expressed concerns over them but it is not unreasonable to use a local to present the case, in fact it's reasonable as it saves travel expenses.

                Ignore set aside.

                I would like to ask for permission to appeal. If they ask why then - I believe the claimants case had no merit and the court has erred in law and fact.

                Try not to interrupt particularly if the judge seems annoyed. However you may need to make yourself heard and not let them introduce stuff like the PCN without being stopped. Ask the court usher, or even the judge before the trial starts, how best to do so in their court.

                  Thank you so much for all this. I've sorted everything (one folder is having a malfunction lol) but I'm ready to go. Got to be there in an hour. I have enough nervous energy to skip there haha. I'll let you know. Eeeeeeeeeek. X

                              Well I'm booked in at 10 in the same room as another case at 10 =/ and I'm still sitting here. Something else I've seen I was going to try and message you because I'm not sure if posting it would be okay but the representative in the case of the three defendants of the high Wycombe case you sent me yesterday is here representing a bunch of them x
