    First two points are her authority. Third point she states that a notice to keeper was issued in September, I appealed the charge (used the appeal process on here), then they replied. They then replied again apparently. Which is BS. That's it. It says it's a witness statement and it's dated today. I never put I appealed in my statement, to be honest I had forgotten I had, also they are ipc and I never had a response! I've only received the original pcn and the letter before action. I'm pretty sure my late witness statement is okay if they can have one submitted within the same week.

                  Dear Gladstones,


                  Thank you for your 2nd witness statement the contents of which are noted. I contend this is inadmissable and will ask the court to rule the same.


                  I note that the witness refers to matters of opinion and has tried to adduce further evidence 4 days before trial in a clear breach of the courts instructions for disclosure.

                      Yes but you weren't that late, didn't introduce crucial evidence and hopefully don't really need yours. They on the other hand do because their pleaded case is well, not really a pleaded case and they might as well have got a 2 year old to do an artists sketch and the court would have the same level of knowledge of their case.

                          Can I just check, are they meant to send me anything else now? Or was that it? Except obviously anything else they find knocking round their office they feel they can stick in a witness statement!

                            Nope.

                            I need to produce a few arguments for you but you should receive nothing from Gladstones or the court.

                            If you have 3 file folders then they'd be handy to put all the papers in to make it easier to flick through stuff.

                              Okay cool ta. I wasn't sure if this legal argument thing needed to be produced or just argued on the day. I'm glad she's coughed up all her legal argument in her witness statement. Handy haha. What like a ring binder thing? Is the judge likely to accept their second witness statement? Or does it really not change my position?

                                Yes a ring binder.

                                The judge should do lots of things to ALL their shite but we must think they won't and then we won't be in court getting a major disappointment.
