    Ok, finance usually means it's a loan to buy a car and it's owned by the person; HP is making payments until you pay the full amount, until then the HP company own the car.

    If it is just finance, it can be taken. It must be moved immediately preferably onto someone else's drive. Do you have a friendly neighbour or relative nearby that will let you park it on their drive for now?

      But I don't pay the finance, someone else does so does that mean they won't be able to have it? I'm going to move it as soon as my brother gets here

        If he does come, he will require proof that its on finance which you can't provide as its not your finance. If you can, move the car.

            HI Jojo

            If the car is on finance it is generally means a HP agreement, this means that the car is owned by the finance company they cannot take it because it does not belong to you.

            You need to advise them that the car is on finance, if you can get a copy of the fiance agreement to show them if they should call this would be good.
            I would move the car in any case though to be on the safe side.

                2 mins, he's not turned up yet and no reply to my text so I'm hoping he is staying away. Brother will be here in less than 10 mins so I can move the car.

                  Just to explain HP agreements have a figure for settlement at the 50% mark and usually another figure which states the one third mark.
                  If this is a HP or conditional sale agreement they cannot take it in any case.

                    Plus the agreement should have the car registration on it in any case, so it does not matter who the agreement may belong to it will show that the car is exempt from being taken.

                      There is no early redemption figure on the last letter sent but does explain about a sum deferred fee which needs to be paid at the end of the contract.

                      my brother has come and taken the car and also given me £100 towards paying it off.
                      what to do next

                      thank you so much for your help so far. Feel like I'm going to be sick with worry.

                      he hasn't turned up, it will be ok after 9pm until I sort something?

                            Oh gosh ok, that's helped a bit. Is it acceptable to pay in 2 weeks or will I need to find the rest of the money right away.

                              Sounds like a conditional sale agreement with a balloon at the end, these would be exempt from being taken, you say a letter ? do you not have the agreement ?

                                Yes I have the agreement it's just filed away with other bills etc so would have to get it out, I int had this letter about 2 weeks ago so it was just 'at hand'
