    Been really stupid, not paid parking fine and now gone to balif.

    had a letter this afternoon saying to pay full amount of £392 or they will take possession of goods.
    i text the balif as I refused to talk as wanted written proof, asked him to text or email only. I said I could pay the full amount within 2 weeks but I could also pay £59 straight away but won't have full balance until then as don't get paid.
    he called within 2 minutes, I rejected the call and he left a very intimidating voicemail.
    word for word this is what it said.....

    Hello miss ******** its ******* ****** from Bristol and sutor.
    i have just looked into your case for the parking fine now and the case is placed out with me to collect the payment in full, it's not up to you to decide you can pay me £50 today or this week or whatever it needs to be paid in full. Furthermore your vehicle is on the number plate recognition system and if seen will be stopped and you will have to pay the full amount immediately or your car will be seized.
    Also your property is now bound and we can enter anytime between the hours of 6am - 9pm to collect goods to be sold.
    This balance has to be paid in full or action will be taken.
    i have checked you car on my system its a (he then says car make model engine size etc) so this will more than cover the debt and I will seize it. You don't really have any other action but to pay in full or your vehicle will be taken straight away. I cannot refuse any payments you wish to make but this will not stop any actions being made against you.



    now, I have offered to pay in full but need to wait til I get paid.
    another thing is that I am the registered keeper of the car but somebody else has finance on it and making the payments not me. Surely they can't seize the car if it's not mine?

    Help lo me please I only have an hour to respond he said

        Move car to a safe place immediately, preferably onto someones drive, where it cannot be touched.

        Txt bailiff straight away and advise that a complaint has gone into the head office at Redditch regarding the demands made. Advise that the bailiff does not have permission to enter the property and that the car has been moved to a safe place. Tell him that you do not wish to deal with him and will not open the door to him. Suggest that he contacts the office before proceeding further.

        Write a complaint to B&S regarding the bailiffs demands and explain how you have promised to pay the total, including fees when you get paid in 2 weeks time. You have £59 spare now that you can pay immidiately if required. If B&S do not agree to this offer can they please advise asap so that you can escalate this complaint to the council.

        CC the council in on the letter.

        There is of course a possibility that the bailiff won't return, they often threaten to and then don't. Remember DO NOT let him in if he does, you are not obliged to do so. Hide the car as well

            HI again, just noticed that the car is on finance, you must tell them this when they contact you, they cannot seize property on finance.

            For information they cannot take anything which has not been taken control of,.

              Oh gosh ok. How do I hide the car, I live on a main road, don't really know the neighbours etc. does this mean he can take the car? It says on the letter not to ring the office as they will just refer it back to him? I've got 2 kids in bed and on my own so don't know how to move the car without getting them up.
              Im in bits. I need the car for work and getting my eldest to school in the morning. I've only just got a job after been laid off hence not being able to pay the fine. Don't want to lose it by getting the car taken away.

              will the car be on the auto recognised thing? Is it ok to pay in 2 weeks or are his demands unacceptable? I will email that address now.
              What am I complaining about? The demands he is making? I have told him twice I can pay in full but not until 2 weeks.

                Head your email "Formal Complaint"

                They will have to look at it.

                Just get the car moved. Drive it to a side street at least 5 mins walk from your house. Your car is at risk until this is resolved.

                You are complaining about his unreasonable demands which are in conflict with the National Standards. You do not have the money but have committed to paying in full in 2 weeks. To take action before then would be unreasonable and disproportionate. Include that you are a single mother on low income.

                If you don't move the car, you are taking a big risk, although I would say that the txt could be enough to stop him

                Can't you ask a neighbour to sit in?

                  No he hasn't been before and I was at work when he came.
                  the letter says
                  as an enforcement agent I have attended your premises today with the intention of taking control of your goods in accordance with taking control of goods fees regs 2014 at this time your goods are bound. You cannot move, remove, sell or otherwise dispose of them.
                  the amount due is ....... This includes an enforcement stage fee of £235

                  please call me on ......... Before 4pm
                  i can then arrange to take payment in full (do not call the office, they will not intervene and will only refer you back to me)

                  signed by by him and dated 25/2/15 at 15:16.

                  i text him at 6 when I got home and he replied with voicemail saying the above and that I had until 8pm to call him to pay in full.

                      If I text him now and say the car is on finance in someone else's name that should stop them seizing the car? My brother is on his way so I can move it but he is about 39 mins away so I'm hoping the balif doesn't turn up

                              I'll I have text him the following....

                              after seeking advice, I am now putting a complaint into head office at redditch, regarding your demands. You, the balif, do not have permission to enter my house and remove goods. The car has been moved to a safe place. I wish to no longer deal with you and I can advice you to contact the office before proceedings.
