      Not necessarily. It is essential that OP proves the fault (the leak) still exists and wasn't repaired properly to justify his right for short term rejection.

          What if the dealer has 'interfered' with the 'vehicle'? it's not in the state that it was when he requested the refund, say they carried out a temporary fix. OP takes it to a garage, they say everything is 'o.k.' no fault, I guarantee that will be the outcome. Read the dealers responses.

          Remember they described a garage as 'Third-Party' which they own.

              I did report this to CAB and I have a reference number, what should I do.
              I did reply to the dealership and stated that water was on a plastic sheet covering the passenger seat and water on the floor.
              I've had no word back yet

                  Good morning River View
                  On reflection to your email
                  When the van was dropped off there was a plastic bag covering the passenger seat which had water on it also the floor was wet and the roof was dripping water so how on earth was it residue from previous repair?????ż?

                  They have responded with
                  Thank you for your email. Our position remains as per our email of Friday in that we could not find a leak in your vehicle nor any issue with the radio. At no stage did the radio just sporadically start working whilst the vehicle was with us, should it prove a problem moving forward, we will cover the cost of replacement at Tony’s audios in Sunderland if required.
                  Please arrange collection of your vehicle and if you wish to get a second opinion on the status of your vehicle then we have no objection to this.

                  That's just what I expected from them

                    If you believe you are within the 30 rejection period, under the Consumer Rights Act 2015, then I would take the matter to the Small Claims Court (this can be a slow process), follow pre-action protocols.

                    They are still trying to say it's after the 30 days you need to get the car inspected to reject it. They want you to prove the car is faulty.

                        Just an update for you.

                        After the previous message on the inspection, I contacted the dealership and asked for a detailed report work carried out.

                        On collection I was informed by the director (Kirsty) that the windscreen had been fully resealed???, I asked about my request for the report but she didn't have it and I had to send a email again which I did and received this,

                        Hello, The very last visit to us involved removing the head lining to inspect for leaks. We found water to have been retained in the head lining so dried it out for you, we also plugged the radio in and found to to be working correctly.
                        Your previous visit to the last involved us sealing a leak in the roof,
                        As discussed, should you have any radio troubles, we will instruct Tony’s audios in Sunderland to assist.

                        I replied with
                        Thank you for your email detailing what work/repairs you have carried out, but you have failed to mention that you have resealed the whole windscreen. I was informed about this repair by Kirsty Heath when I collected the van.
                        His response wasn't what I expected
                        I was rushed as getting an mri scan at the time for a shoulder injury caused when someone tried to snatch Kirsty’s handbag, apologies.

                        I only know about this as the roof lining was full of black finger marks and I asked Kirsty to clean it and then she came out with the lining had been removed and the windscreen had been fully resealed (wow)

                        So he is agreeing that the windscreen has been resealed this time when it went in for inspection but there was no leak??

                        I'm going to a Renault garage for an inspection and then I'll send a court letter

                          They say one thing and do something else, they are constantly shifting sands, update when you get the inspection report, they shouldn't be fixing anything (I did say they would). Update when you get your report. Make sure you back up your communications.

                            Hello everyone
                            I've had the van inspected by a Renault dealership and the report came back as having leaks.
                            I've sent a letter regarding court action and a copy of the report to the dealership.
                            I Have received a letter from legal solutions 4 U who are saying.

                            We would propose that in order to reach a swift and final resolution that we will instruct an independent engineer to attend your home/work to inspect the Vehicle and
                            if they concur with your report from Evans Halshaw then Riverview Cars Ltd will
                            accept the rejection of the Vehicle.

                              I'd write back that they've already had the opportunity to inspect the 'vehicle' (no doubt the Independent Engineer will be associated with Riverview Cars Ltd) and that you've already rejected the car. They told you to get it inspected, which Evand Halshaw has done, they have found 'leaks'. Did you give them a deadline to refund?

                              Wait for others to comment. They are just making it up as they go along.

                                Well I would just tell them they have a fortnight in which to make the refund.
                                If it 's not forthcoming you will initiate a court claim without further reference to themselves.
