    Hi, Even though I have not signed to authorise Synergy and sent them a letter as stated previously (which they did not respond to) They have sent me an invoice and now an reminder.
    What course of action would you recommend?

      Jim I have raised this issue with the MOJ/TS and am still awaiting a final response. Have you actually contacted the MOJ/TS at Burton on Trent as the more complaints they get they are more likely to act mailto:consumer@claimsregulation.gov.uk.

      However, in correspondence from the MOJ/TS on another members concerns as it appears that Gravity did in fact go bust and they were mentioned on the documentaion from MSE but then continued to trade under Synergy with exactly the same authorisation number. I have raised my concerns again with the MOJ/TS as this seems ridiculous that a company can go bust and can continue trade with the same authorisation number and whilst all the debts of the prior company get washed away.

      You could do one more thing that is to write to Synergy, do not sign the letter with your usual signature (just block capitals) and ask for the documentary evidence and the proof that they actually have the right to pursue you as you do not recognise them as ever having signed any documentaion with them and that you fully dispute the debt. This should get them off your back as they will not be able to back up their claim for this debt (hopefully).

      I am still not convinced that when Gravity went down and wiped out all their debts that Synergy could reap all the rewards and use the same authorisation number and I am totally surprised at the MOJ for allowing this.

        Thank goodness you never signed those documents Jim from Synergy. Without a signed document from you with your signature I do not see that they could make a claim from you.

        The only thing is that is bothering me is that Synergy are trading with the same authorisation as Gravity.

              Here is the reply I recieved from the MOJ

              Dear Mr xxxxxxxxx,

              Thank you for your email. I refer to your complaint against Synergy Financial Solutions Limited.

              The Ministry of Justice regulates claims management companies by enforcing the Compensation Act 2006 and underlying legislation. Enforcement action is taken against businesses which fail to comply with the conduct rules, a copy of which can be found on our website. From your email, however, it does not appear as though Synergy Financial Solutions has breached these rules. If you have concerns regarding a possible breach of the Data Protection Act 1998 please contact the Information Commissioners Office on 0303 1231113.

              I note from your email that you have previously contracted with Client Connection Limited. This business also traded under the previous trading styles of CCR, Money Claiming Experts and Cento Client Review. If you have refused to sign the Terms of Business with Synergy Financial Solutions Ltd then your contractual agreement remains with Client Connection Limited and Synergy Financial Solutions Limited will be unable to act on your behalf.

              Client Connection Limited

              Client Connection Limited surrendered their authorisation to conduct regulated claims management services on 5th October 2012. This means that they can not continue with any regulated claims management services, and can not fulfil their obligations to you under the contract. Please note that if the business has completed their service, and settlement has been made then the business will still be entitled to their success fees.

              On 9th October 2012, Client Connection entered administration and Sharma Associates Limited trading as Sharma and Co were appointed to the administrators. Their role is to attempt to resolve any outstanding problems with the business.

              You may have paid an up front fee to this business, whether you can get this money refunded to you is dependent on how you paid the fee.

              Credit Card

              If you paid an upfront fee which is over £100 then you will be able to make a claim to your credit card provider under section 75 of the Consumer Credit Act 1974.

              Your credit card provider is jointly and severally liable for the breach of contract. I would therefore suggest contacting your credit card provider to request a refund under section 75 of the Consumer Credit Act 1974.

              On some occasions, credit card providers have rejected these claims. In these circumstances you are able to appeal their decision through the Financial Ombudsman Service (FOS). The FOS can be contacted on 0800 023 4567.
              If your claim for a refund is rejected by both your credit card provider and the FOS, please contact the administrators of Client Connection Limited. Consumers wishing to list themselves as creditors should contact Sharma Associates Ltd trading as Sharma and Co on 0121 454 2700 or email recover@sharmaandco.com

              Debit Card

              If you have paid your upfront fee by debit card, you may be able to obtain a refund by requesting a ‘Chargeback’. This is not guaranteed, and it is dependent on your bank. Generally, you have 120 days after you realise that there is a problem to make a claim.

                I think this is a bit ambiguous and you need to respond with the following:

                I thank you for your e-mail but remain unclear as to the status of my obligations to Synergy from a regulatory perspective.

                On the one hand you seem to suggest that in not agreeing to sign any contract with Synergy I have no obligation towards them but on the other you clearly imply that they can send me demands for payment without being in breach of your rules. This is impossible reconcile.

                Could you please clarify whether I owe any payment to Synergy or not and if not how can they have not breached your rules, particularly in respect of their regulatory obligation to treat customers fairly.

                    I think the reply is a bit naff too from the MOJ how I read it was if any fees were owed to Client Connections Ltd, then they should be paid to Sharmas but that's just how I read it lol

                      Even the MOJ still seem to be having problems with the web of deciept that has gone on with the CCL -Lifestyle Claims and are they are still not able to make a definative decision about the rights and wrongs of this cases of Synergy and those of Reddhawk.

                      Please Jim, write the letter to the MOJ/TS as Exc has suggested and see if the MOJ/TS will be able to clarify the position more clearly for you.

                      Did you write that letter of complaint to Synergy as both Exc and I advised you?

                        Yep that would have been the case but the contracts were very converluted and these contracts stated clearly that payments and a percentage would be made to either ULL, Gravity or Legal Redgress to name but just three companies.

                        What actually happened here with Gravity is that they went broke, cleared all their debts and got a clean slate. Then started a new company called Synergy and carried on with the same authorisation number as Gravity - why that was allowed by the MOJ I have no idea TBVH as that seems to make a mockery out of the system, So any CMC or any Limited Company can go broke loose all their debts, start a new company and pick up the pickings from the company that went under and the MOJ believe that is OK.

                        The thing is Synergy and Redhawk both got greedy and wanted a higher percentage and sent new forms for the ex clients of CCL to sign. Well Redhawk were not named on the orinal documents, but according to the MOJ at our meeting they said that their was a clause in the contracts to pass the contracts on to Tom, Dick or Harry - that is the sad thing it is all in the small print.

                          Hi My name is Joan. I was first contacted back in April 2010 with regards to a PPI enquiry by CCR who then did nothing. on the 24th June 2011 I was asked by lifestyle if I wanted to proceed with the claim. I heard nothing more till a few months ago when Utimate law said I had won my case and moneys would be coming to me. There fee had already been taken care of nothing to pay. Since the cheque turned up I have had Redhawk Legal constantly ringing or sending letters demanding £3442.79. I have never heard of them before. I have never had a form, letter or phone call asking me if I wanted them to represent me. But the worst thing is I have just received a letter from Universal Collections ltd, who are a debut collector. demanding payment by 8th may. What should I do

                              Hi joan
                              Your story is the same as many others that had dealings with Lifestyle Claims. As long as you have not signed any paperwork with Redhawk, Univeral at this time will not succeed as they do not have an OFT licence to chase debts and they have already been reported.

                              Please can you scan and send all your documents that you have including any letters to Chris Woods at the Ministry of Justice/Trading Standards as he is dealing with all the complaints with regards to Lifestyle, Redhawk and Universal - c.woods@claimsregulation.gov.uk the more complaints they get the better as they told us that they do not act on just one complaint.

                              Please let us know how you get on and do not let Universal intimidate you as they have no right whatsoever to even be debt collecting without holding the necesary licence.

                              Also drop a line to the OFT and mark the subject as ''Universal Collections Ltd - No CCL report''

                              I wish to report Universal Collections Ltd (company number 8198368) as operating without declaring or holding the required consumer credit licence. Please find attached. According to the CCL register Universal Collections Ltd have applied for a licence (your ref 0655327) but their application status is ''pending''.
