    PKea, hiya, has Amethyst been online recently? not had any replies from her. I hope shes ok. Its just that I wrote to the house of commons to a guy I know asking if the Social Security Act applies to bank charges. He wrote to that department and he has sent me their reply. I dont want to post it on here and would rather an Admin person read it first. If I cant get hold of Amethyst could I send it you. or is there someone else I could post it to. It makes a massive change to claims and we have the commons permission to post the reply on here for others to read, something else I dont know how to do.lol

            Hiya everyone and Amethyst
            Hope you all had a good xmas and new year. Sorry its been ages since ive been on. Work, xmas etc had took all my time. Anyway some victory news. I had appealed against the council as they had stopped my c.tax benefits and housing benefit saying I didnt send my tax credits awards letter all 8 pages to them when I did. I claim they had lost half of it and they claimed I never sent it. I appeared twice in the appeal courts and received news today that they had no grounds to suspend or cancel my claim and to pay me what I was entitled to from 7th Jan 08 to 23rd Aug 08. Talk about dancing round the front room. Doesnt a win elate you!! If you want a fuller story for the benefit of anyone having these issues let me know but I would advise anyone to appeal if they have the same probs.
            Next the bank.......lol

                Thankyou. Its thanks to this site that I won and the encouragement and info here that ppl kindly offer. I am trying to read up on the bank situ now as im with rbs and I believe there was a court hearing in Jan 09. The hardest bit for me is trying to get the jist of where I stand with a hardship claim. Im gonna go thru the bank threads and catch up on whats been happening.

                  I need some advice if someone could help. I won my appeal against my council for the benefits they suspended for 7 months on the fact that they had no grounds to suspend or cancel my claim. I wrote to them asking them to pay all the money they owe me into my bank and I have received a reply saying they are appealing against the decision. I cant believe it. Its been a year, i ended up in debt and had to move due to rent arrears as I couldnt afford to pay full rent. I shouldnt have had to as I work part time and am on tax credits. I cant believe a council will be so hell bent on not paying out government money allocated to peope who are entitled to it. Does anyone know what my rights are and who I can write to to complain about the council. I know I can write to the ombudsman but is there anywhere else. I want to complain to someone who will give them a kick up the arse and embarrass them.
                  Any help will be greatly appreciated.

                    Speak to The Citizens Advice Bureau immediately; they may be able to sort it today. Otherwise, I am sure someone on the site will be able to offer further help.

                    The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

                      Sorry ive not been online for quite a while had loads of mad stuff happening. Anyway a quick update if anyone remembers not long ago I appealed against the councils decision not to pay my housing benefit or council tax due to lost paperwork from the council as they had said I hadnt sent it in. Well I won!! I got every penny back so it is well worth appealing. My problem now is I moved in Aug last year and notified everyone including the bank. I have been into the bank and checked and they have my new address. Ive ordered cheque books but they havnt arrived. Last month a charge went out of my account which put me overdrawn and then they had the cheek to charge me for going overdrawn on top of that! I phoned and complained but they wouldnt refund the charges saying I had been sent a letter warning me about the charge. I replied I hadnt had any paperwork from the bank for a few months and only realised during this conversation. They said they would ring me back and did saying I couldnt have a refund as I had had long enough to queery where my mail was. I said I dont spent my days thinking about the bank and hadnt realised till now. Apparently for reasons the bank cant explain my mail is being diverted to their head office despite having my new address since last year. When I looked back on my account to when I moved they have taken a total of £1028 out in charges and ive never had a statement or letter from them. Due to the court case thats ongoing with the banks could I still complain to claim the whole amount back due to never having received notification first and the fact that the bank have my new address and have no reason not to send it to head office instead.
                      Any suggestions to my rights would be much appreciated.

                        You should reclaim your charges in any case not specifically because they have not sent you your statements or letters detailing the charges.

                          Ok thanks I will. I put a claim in about 2 years ago which is on hold but not for the ones I am claiming for now. Any ideas as to what to put in the letter would be great as letters are not my strong point. Do I send it to the head office at the bank or the Ombudsman.
