    Re: BF v Abbey

I dont think its making any difference ringing him hunny tbh. The claims seem to be being dealt with in batches over at Abbey and as a batch is dealt with its being sent back over to Ronan to contact the claimants.

You are in the pile, he has confirmed that, so you just have to wait till it comes back from the hardship decision makers. Am sure he will contact people as soon as he has the batch back.

I know its hell waiting you just have to try be patient. ((((((((((((((((((((((((hug)))))))))))))))))))))))

There is some truth in what Cetelco has posted.

However, neither telephoning or emailing or letter writing seems to have progressed matters in Blooming Flowers claim whereas one or all of these methods have worked for others.

Personally, I think that Blooming Flower should continue to phone and email and write letters and make as much of a nuisance of herself as she possibly can until this matter gets sorted.

She is in genuine financial hardship and the situation is getting worse each day that passes. There is nothing wrong in making Ronan aware of that fact and insisting that he does something about it. He is supposedly there to assist people so let's get hom doing some work for his money.

        Thanxs for your reply Bud..:tinysmile_grin_t:

I have just drafted up a another letter ready to send off to Abbey. Have also sent it to Bud to see if it is ok. This will be the final one before I get in touch with the FSA and the FOS.. we are into the 6th week and still no reply from Ronan. I know that Abbey have a timescale to deal with hardship claims within 8 weeks, but cannot understand why it is taking Abbey so long to clarify us as a Hardship case. They have all the evidence in front of them, which was sent weeks ago.... unless they have lost it !

Our situation is getting worse day by day.. we have since received a letter from Orbit (Housing Association) reminding us about the level of arrears we have.. if we dont get this sorted by the end of this month and try and reduce arrears to a reasonable level... they will serve a Notice of Seeking Possession order on us..

(Will try to attach letter to my post from orbit.. but Im completely useless as don't know how to use the scanner bit.. lol )

ok.. here is the finished letter.. thankyou to Bud for editing and tidying it up for me.... have just this minute emailed it to Ronan and will also be sending it via snail mail to the hardship team at Abbey.....

                Abbey PLC

                16th September 2008

                Dear Abbey/Hardship Team

In 2007, we issued court claims for the refund of bank charges. These have been stayed pending the result of the OFT v Banks Test Case. Total amount of claims currently stands at £6,959.47

On the 4th of August 08 we wrote to Ronan Coyle of Ashursts (Legal, Triton Square address) advising that we are suffering severe financial hardship. We also sent original copies of relevant documentation, on request, by special delivery (next day), which included evidence of our hardship situation.

Six weeks have now passed since we first wrote to Mr Coyle and we still await a decision. We are extremely disappointed and cannot understand why it is taking such a long time for you to confirm our hardship situation.

Our situation has worsened considerably in the intervening period.

Enclosed is an original copy of a letter from our Housing Association regarding rent arrears. The amount owing, at 8th September 2008, is £829.46. We have been advised that a notice seeking possession will be served upon us if the arrears are not cleared this month.

We therefore cannot sufficiently stress the urgency of our situation and we further request that the Abbey hardship team do take this into consideration when reviewing our circumstances.

As our situation is worsening by the day we feel that we have no other choice than to report this situation directly to the FSA and the FOS.

We still hope to avoid this action and will allow a further 3 working days from the date of this letter before contacting the above mentioned organisations.

Our rent arrears, as at the 15th September 2008, are now £939.03

Our Council tax arrears as at 15th September 2008 are now £3905.64

                Yours sincerely

                    Re: BF v Abbey

Can you call the complaints team and ask them for a fax number for he hardship team, compliants and anyone else reomtely able to help rather than thaving suffering the delay of sending it via snail mail.

You could alway fax it to Ronan aswell - Perhaps as Bud says, if you bombard him (politely and nicely of course!!) then he might actually do something about getting this isue resolved for you.

I really hope you get a positive outcome soon hun, I have everything double crossed for you!!!!

Hi All ! Just a quick update............

We have still been awaiting a reply back from Ronan/ Abbey after sending the last letter via email.. (what a surprise !) They have til Monday (22nd) the latest to reply back before we take the next step to submit an application to the court regarding our hardship claim. Before doing this we will need to send Abbey a revised I+E sheet and an application/poc before submitting to court.

Am also gonna try all other angles and write to the FSA/FOS..

Abbey will need to sit up and take notice of our hardship at some point !

Six weeks will have now passed since submitting Hardship Claim to Ronan. We included all proof showing low income, ie Wage slips, Child and Working Tax Credits,, Debt letters, Arrears etc etc....,We have also received a letter from our Housing Association reminding us of our rent arrears and have been advised that a Notice of Seeking Possession will be served on us if we dont pay the arrears. Our situation is going from bad to worse.

We have 5 claims altogether..4 have been stayed pending the result of test case and the 5th claim is at prelim stage..

However, we have already bundled all of these claims together as one claim on one spreadsheet ( with stat int ) in which Ronan/Abbey have in thier possession.

                          Hiya BF

Did you by any chance contact the CEO at Abbey to ask them to help you! as you have not had even an acknowledgement to your claim for hardship.

It does seem strange that yours has not been dealt with given the time span for everyone elses and wonder if you papers have been misplaced /lost and this is the reason for the undue delay. If only Ronan could have made some enquiries on your behalf with the relevant department to ensure that they have your papers and that someone will definately dealing with them.

We are all still routing for you hun.

                          All the best

We're all on your side and hoping that you will be celebrating soon
