        Just an update. I've received a letter from court today. Lowell solicitors have issued court proceedings against me in a small claims court. What I want to ask is, what do I say in the response paperwork? I obviously can't afford to pay this back and I don't want to get a CCJ. Is there any advice on what to do?

          Carlos post a copy of the Claim Form after removing your name address an the claim number or type in the particulars of claim word for word.

            I'll give some background info.
            I took out a capital1 credit card and ran up the credit card. I was not in the right frame of mind at the time and was currently and still am receiving mental health support and medication. After running up the card I ended up in prison and believe around then I got a default. I spent just under a year in prison and have been out now for 3 years. I've turned my life around and have a family now. I've not commited any other crime and have started my own business. I'm currently on benefits because I'm working at a virtual loss (I won't give up). I'm already paying back 2.5k over payment from the benefits (no fault of my own) and paying a business loan back that helped me set myself up. I have a partner on maternity leave an a 5 month old baby. If I had the money I would pay this debt. How do I make it all go away or stop them hounding me and giving me a CCJ?

                    You need to send a CCA request to Lowell £1 statutory fee ( postal order marked for statutory fee only on both sides, make a copy and keep for your records.
                    See green shortcuts box above.

                    Use signed for post check delivery date and signature (print a copy)

                    Send a request under the provisions of CPR 31.14 for the documents mentioned in the particulars of claim (no fee) to Lowell solicitors by signed for post.

                      I've already sent a request for the agreement and statement of account to lowell few weeks back and they sent one what I asked back. Think you have uploaded it for me above somewhere. Do I need to re send for another? I've not acknowledged anything yet but will do now

                              On 19.04.16 I received a County Court claim from yourselves of which I have acknowledged receipt indicating my intention to defend in full.

                              To enable me to file my defence and/or counterclaim, I require inspection of documents you mention in your statement of case ahead of filing my defence.

                              In accordance with CPR 31.15(c) I undertake to be responsible for your reasonable copying costs incurred in complying with this CPR 31.14 request.

Had your claim not been issued through CCBC the Claimant would have been obliged to attach copies of the documentation upon which it relies to the Particulars of Claim.
