        Unless you have a clear case of misselling (and sorry so far it doesn't seem like you have) I wouldn't recommend taking it to court.

        However If you do decide to go that route you need to make a formal complaint to Train2Game about the issues you feel you had with the course. Writing and saying 'someone else said it was a etc' really isn't going to work in your favour. You then would need to give them 14 days notice you intend to take court action, and on what basis.

        Then of course you need to deal with the finance company separately - your finance agreement has defaulted and is now with Cabot I believe - so you really would be looking for a refund from Train2Game, which you would then use to negotiate settlement with Cabot.

        Going to court would cost you a different amount depending on how much you are thinking of claiming back. See leaflet EX50 - Civil and Family Court Fees - High Court, County Court and Family Proceedings Courts. You'd need the N1 form and to complete your statement of case with the legal reasoning behind the claim and why you should be given a full or partial refund.

        If the claim is considered vexatious or an abuse of process then you may be asked to pay the defendants costs. If you lose there may be some defendants costs to pay as well ( as long as your claim is under £10k it shouldn't be too much, maybe £400 at a guestimate) If you won you would be able to reclaim your court fees.

        Damages ? (I assume you mean emotional / financial distress type pain??) - very unlikely unless you can evidence some detriment you have suffered due to the alleged misselling of the course.

          Hi Kati I have been missold the course from being hard sold the course I did tell the lady that I didnt want to meet up with her. I then looked over the course and felt that I was pressurised into the course. The agreement has been sent back to CDF. From Cabot Financial. After hearing the news about my Uncle having lung Cancer I was very depressed. About everything to my uncle as he is a great person. about the whole decision of that Cabot not refunding me the money very annoyed with them also. CDF and Train to game I have alot of evidence from breach of contract etc. It has been horrible for myself and It would be great for a refund.

            If you believe that you were pressured into signing the credit agreement then you can get lots of advice from your local CAB!!!

            Disputing a debt
            due to misselling can be a long process, and will often end up being your word against theirs. So any written proof you have can be vital to your success.

              Am I right in thinking you cancelled after the Cancelation period allowed and after receiving some literature from the Course and deciding it was not what you signed up for?

                Hi I took out a course with Train2Game back in 2009 started the course and cancelled my direct debit as to moving flat and getting a new job I then got contacted by a debt collection agency Cabot Financial where I set up an agreement with them in 2011.
                I started the course in 2009 about a year to 2010 then I moved out of my flat cancelled the direct debits the course was pretty rubbish gave you a qualification to get you a job in computer game design but there was no guaranteed job vacancy. support and tutoring no.
                Timeline was from Aug-Oct 14 I took the course out in 2009 2010-2011 DCA so 2011-2012 DCA to 2014 the debt collection agency was with Cabot financial. I paid £2000 odd pounds the agreement was for £4860.
                I started the course in 2009. I'm not sure how far I got into the course I did get sent the course materials I still have them. I did send off the modules to be marked. Online

                  Looking at this as an outsider I cannot see any claim being successful just the opposite the companies may try counter claims that will cost the OP .
                  Personally I don't see there are any guarantees of employment with these courses .

                    Unfortunately, I agree Wales ... however I would rather give the OP all the relevant advice so that he doesn't go blindly into any action.

                    I believe there might have been a strong case for misselling if the coursework had fraudulently shown endorsements (as has been shown in the past) but that isn't the case here :tinysmile_hmm_t2:
                    It would have been better (IMO) if the course had been cancelled earlier - and if the OP had not just cancelled his direct debit to CDF. Additionally, his payments to DCAs in relation to the finance agreement is problematic too ... it could be seen as acceptance of the debt (and therefore acceptance by proxy of the course itself).

                    Edit 17th October 2014: I stand by my statement as to believing there might have been a case for misselling although I did add that it wasn't the case here (see above and also post #46 on page two of this thread).

                        To be honest the course Is cancelled I'm happy with this. And it will cost me money it is being investigated by the FOS so I will wait and see what happens. At least I'm not paying any of the fees The CAB they basically told me that I could only pay a £1 legally they were'nt very helpful. I'll just hope for the best cheers.

                          The course is cancelled through t2g... but you need to make sure CDF have stopped charging you for the finance side of it too :tinysmile_hmm_t2:
