      OK, I spoke to the ICO. They seemed to think it's a pretty open and shut case RE Vodafone. They need to supply the SAR within the 40 days and they have not done so. I have proof in that I have the recorded delivery signature and they have cashed my cheque. The ICO have told me to make an official complaint (as was recommended here) but they say this will take some time. No surprise there.I just need to get a copy of the recorded delivery print out as well as a bank statement proving they cashed the cheque then get that sent off. Obviously, I've still not heard anything from Vodafone themselves and tomorrow will mark one week over the allotted 40 days. I wouldn't be surprised if I'm waiting another 40 days. It's getting quite frustrating because I'm very curious about what, if anything, they have sent to Lowell.

      On another note, ever since I applied for my Equifax credit file I have been bombarded with phone calls from dodgy companies, for fake insurance claims etc. No coincidence I'm sure. Must remember to not put real mobile numbers on the forms! I'm not overly concerned as I'm changing that number shortly. I've been ignoring them but have started to wonder whether it might be more fun to answer and play some games with them.

        Evening all,

        I haven't forgotten about this thread. I never heard from Vodafone regarding my SAR, even after sending them a reminder. Not so much as an acknowledgement. My complaint is now with the ICO.

        However, interestingly, I have had another letter from the Leeds Losers saying if I don't pay within 21 days "the decision has been taken to send your account to another debt collection agency that will pursue you for this debt. They will be instructed to recover the full balance from you and you will not have the opportunity of any substantial discount"

        Well, thank you Kevin Allmark, Collections Manager for your kind offer.

        My priority at the moment, is to get them to remove the the default they applied to my credit file, then to instigate a claim for harassment. This latest piece of toilet roll surely is concrete evidence that they do not have any proof that I owe this debt. Therefore, I am not waiting around for Vodafone to pull their finger out. I'm going in straight to Lowell now.

        I would however, like to open it to the floor for any suggestions for the content of my letter.

          I wouldnt like to dictate what to put on your letter but i will say that the next collection agency they will pass you to will be yet another trading name of lowell. Maybe each member of staff has their own company name ay.

          your doing all the right things anyway so keep going, Im sure the guys on here will be along to assist with that letter shortly

                Must have been their day for decimating a rain forest with their mass mailings of junk mail. Got one today from them telling me that they were not going to write anymore that it was going to the desk beside the Fire Exit in the threat centre or as they like to call it Hampton Legal

                        how many times can you request a SAR? I did to Barclaycard a few years back which turned up no CCA, Lowells eventually offered 50% off alleged debt so i know they can't really do owt.

                        Also how do you make payment to them? I presume the lowlifes would ignor the SAR and just take the £10 payment off the balance to start the ball rolling again!

                          You could probably request a SAR as many times as you like but it would be a waste of your time and money. You would be better off writing to Lowell telling them to prove it or f*ck off. They will probably ignore this and carry on with their letters, you could consider a claim for harassment at this point. They would certainly not ignore the SAR and take the £10 fee off the balance, after just having a long conversation with the Information Commissioners Office they would be in big big trouble for doing this, although you would likely need to take them to court for non compliance with the Data Protection Act. If you did SAR Lowell you would need to make sure that you tell them the £10 is for the SAR fee only and not for any alleged debt. Just make sure that you send it recorded delivery and then print out and keep a copy of the signature and also a copy of proof that they have cashed the cheque, whether thats a bank statement or whatever.

                            Update!

                            STILL haven't had any reply to my SAR from Vodafone. The Information Commissioners Office have also not had a response from them. I have just got off the phone to ICO who will chase Vodafone today and will then likely provide a judgement of non-compliance. This is good but also not so good. It's not so good because it doesn't actually get me the information. It then gets passed onto the 'Complaint Resolution' department of the ICO, but that will likely take weeks to resolve. My other option is to take Vodafone to court. I have a very strong case so it's likely that is what I will do.

                            Yes, that's right if you want your details from Vodafone, you have to take them to court to get it. They will openly flout the law and ignore you in the hope that you will just go away. What are you hiding Vodafone?

                              Mini Update....

                              I now have my SAR from Vodafone! Better (very) late than never I guess. A minor apology included for the delay. There's obviously a lot of paperwork to go through but interestingly, in clear black and white, it shows that they took the £10 SAR fee and deducted it from the alleged debt, despite me clearly stating that the fee was for the SAR only....

                              Be very interested to see what the Information Commissioners Office make of that when I call them on Monday.

                                I had a text message this morning from the shysters at Hamptons. It was actually for someone else, not me. I called them and told them to remove my number from their records. This afternoon I got an automated voice message for the same person from Lowells, which we all know is the same company. I called them and gave the guy a real dressing down and told him if he didn't remove my number, NOW, I would consider legal action against them for breaching the Data Protection Act and for pestering an innocent person. He became quite stroppy and demanded to know who I was, I told him it was none of his business, so needless to say he got both barrels from me. Has anyone else had this happen to them?
