    Evening Bluebottle,

    The SAR request to Vodafone requires them to send all correspondence sent to third parties, surely that will tell me whether they instructed Lowell? It will also tell me whether Vodafone were under the impression that the account was settled.

    Assuming that there is nothing in the SAR paperwork instructing Lowell then I can write to them, as you say, knowing that they won't be able to provide anything. No proof = no ability to chase the 'debt'

    I think I'm getting my battle plan together.

      Even without the SAR from Vodafone the Leeds Losers wouldn't be able to take you to court anyway

        If there is nothing in the documents Vodafone send you, proving that they instructed Lowells, you can safely say that Lowells did this off their own bat, in which case, they'll have some explaining to do. If Vodafone confirm the account was settled, this will compound Lowell's involvement in the matter and throw the spotlight on them. As you say, "No proof of lawful debt, no lawful reason to pursue." When you receive all the paperwork, Angel, PM me and let me know what they've sent. It should be easier to help you formulate a battle plan that will give Lowells something to think about.

          Hi guys,

          Just to let you know that I haven't forgotten about this thread. I sent the SAR request to Vodafone and the 40 days has expired. They have received the request and cashed the £10 fee. I have now written a Letter Before Action asking them to comply with the request within 7 days or I file a court claim. Getting it posted ASAP.

          Any ideas on a template for Particulars of Claim for this kind of thing?

              I agree with AC. The more bad conduct on Vodafone's part which you can show a court, the less chance they have of getting the Judge to view them with any sympathy. Gather the evidence.

                  As of 6 April 2010, the Information Commissioner's Office deals with all breaches of the DPA. ICO has the power to fine firms and individuals who breach the DPA up to £500K. Go to Data Protection and Freedom of Information advice - ICO

                    OK cool. I will call the ICO tomorrow for some advice, with a view to making a complaint. Maybe I should tone down my chaser to Vodafone a little, taking out the court bit?

                    I've still been getting letters from Red/Hamptons. Got one from Hamptons today in fact offering me a 50% reduction. Apparently if I don't pay within however many days it is this time they will apply to the court for a CCJ! If only it worked like that! Unfortunately for them I can see through their games.

                              Oh I know they are all one and the same. The first thing I thought when I saw the 50% discount was that they were making one last desperate attempt, I said that to my other half. Interestingly, the full amount is less than the full amount they were begging for last time, they can't even get that right.

                              I know that unless I actually deal with it in terms of telling them where to stick it, once I have the SAR from Vodafone, the whole circle will just start up again in X months time. I will start getting letters from Lowell and then Red etc etc. They are like a bad rash that never really goes away.
