    They send me a monthly 'Client Log'. I'd say it was a statement. It shows the companies, my account numbers & the amounts they have paid them, along with the management fee..

    The final charging order in Bradford for the nationwide, went through on the 18th May 2009... I've got the county court stamped notice...

    Moorcroft Debt rec 13.98
    UCA 2.00

    I haven't received any paperwork from any of these for well over a year now so am unable to say what is owed.
    I know the bradford order is for 9211.63 & that 1 of the above collects for egg & egg sent me a statement in April, showing a balance of £15962.00...

    I would have to write to everyone or ring my dmc for outstanding balances.

      most of those are debt collection agencies - do you know who the original creditors are. I would be tempted to ask the DMC for an update of balances outstanding so you can see how things are going....if you are bumbling along without any hassle from them then you might want to leave it as it is, but with the charging orders coming up some are still taking you to court etc - is correspondance from the DCAs going direct to the DMC ?

      Okay reference the hardship claim. £400 in two months is pretty diabolical. have you switched accounts where your money is paid in to now ?

      are you on top of all the priority debts - charge order installments / utilities / mortgage / council tax etc ?

        All correspondence goes directly to drd. I will call them tomorrow to see what is outstanding for each. I will also confirm who the original debt was with.
        I get full council tax benefit so that is not an issue.
        My utilities are up to date, as is my mortgage. I have my mortgage interest paid for me.
        I think the benefits agency are still paying at 6% interest so my mortgage is in fact overpaid at the moment as I am on a tracker @ .5 over the base rate...
        Regarding the bank account, all money is paid into a different account.

        p.s. the benefits agency must be wasting millions on mortgage interest payments at the moment with still paying at that rate!

          Okey dokey, well I think you might struggle with hardship - however we can fight to get that £400 back - whats the state of the account @ a&L now ?


          Do you know what charges you had prior to that ( since july 2001 actually) if not we can send off a data protection act request to ask for all your transaction lists to get some figures to get your case in the system

            I've no idea about the charges.
            Will I struggle with hardship because my mortgage is up to date & because of the council tax benefit?

            The a & l account has been suspended to prevent them from charging more fees & has been sent to their debt recovery section.

              okay, how much is the debt on the account ?

              we'll get a DPA request off and a hardship claim in (don't think it will get through becuase you are okay on prioritys and are in a DMP (unfair i know) but doesnt hurt to try and gets the account into dispute so they cant/shouldnt hassle you about it)

                At the moment, the final letter says £640.01 plus overdraft fees which they will charge on my next statement. I think these were quoted as £105 on my statement.

                The balance was higher...they took some of the charges off as an act of goodwill whilst I was on the phone.

                My overdraft limit with them is £250.

                  This is the template letter for the data protection act request - it will cost £10

                  Once you get the debt figures we'll get the hardship letter written and sent off too, but the DPA is the first one needs to go to A&L.

                      no worries, let me know when u get the outstanding balances from your DMC and we'll get a chivvy on with the hardship letter, get you in the system before they try enforcing the debt on the overdraft via the DCA.

                              I rang my dmc today. They don't know what my outstanding balances are for each company!!! I asked them to find out for me & they said it will take approximately 1 month!

                              I also enquired about reclaiming bank & credit card charges & they charge a person 15% of what they get back + VAT. Outrageous.

                                sigh.

                                okay, grrrr thats pretty dire. with CCCS i get a monthly statement showing monthly payment, starting balance, current balance etc (and they don't take anything from my monthly payment either) a MONTH is ridiculous, they are meant to be managing your finances how on earth can they do that when they dont even know whats owing to who - no wonder they just allowed you to get these charge orders.

                                okay so we know you have approx 40k - will try work that out proportionally with your monthly payments.

                                how hard do you want to fight the debt (ie how strong you feeling) all those debts with dCAs were probably sold to them for what 10% of their original value, some won't have original paperwork and you could, if you wanted, take back control of the debts yourself, reclaim charges/PPI on them - but to do that we're going to need to do CCA requests and DPA requests on them to find out where you are at. If you are happy with it running along with DRD for now then you could say tackle one a month (going on the basis you wont fancy shelling out £10 for each DPA request in one go and really they are better with the original creditors)

                                Do you know who the original creditors are for these ?
