    What is the balance on the account Flangies ?

    Also, please could you post up copies of the preliminary and LBA letters and the spreadsheet that you have sent to Capital One. Make sure that you remove any personal identification information such as your name , address, account number etc before posting.

        Ok recieved ny letter from Cap One after sendng the LBA telling them I wasnt going to accept the £160 goodwill gesture plus £10 interest. its now time to file into court isnt it. please remind what letter itis now?

        Here is what this letter says:
        Thank you for writing back to meabout my offer of a refund of £170. I am sorry to hear that you are unhappy with my offer.

        As I have already explained were confident our default charges are both fair and legal and I am dissapointed your considering court action. The OFT hasnt told us that we are obliged to refund any default sums and we have offered these refunds as a goodwill gesture. I will not be refunded allof the defaults sums as you have asked.

        My offer of £170 is still open to you; I will not be incresing this and it is my final offer.

        The offer is stil open to you should you wish to accept it and enclosed is the settlement form if you decide you want to accept it.

        Financial regulations require me to advise you that this is my final response in relation to this matter, however you have the option to contact the FOS within six months from the date of this letter, contact details are in our leaflet enclosed.

        Once again I look forward to receiving your signed settlement form so we can put this behind us and save the courts valuable time.

          I am sure everone has been busy with this lovely weather and hasnt been looking and watching this site, However if someone could just comment on my message and give me a little advice; i thninks help with the POC will be needed for sure.

                  Ok folks; filling in me NI and cannot find anywhere the court fees? any ideas and the section which states on NI interest under s.69 county courts act 1984£? I am claiming compound so is it that figure on my spreadsheet?

                    c) The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% per annum, from the date of each charge as detailed on the attached schedule of charges to 8.07.2009 of £1,024.00 and also interest at the same rate up to the date of judgment or settlement at a daily rate of £?? per day

                      Oh my god really sorry more questions; I knew I would struggle with this part POC;
                      4. The Claimant has requested on [Insert date of T&C Letters] a copy of the terms and conditions - What terms & conditions letters?
                      that related to the account at the time of signing his/her contract, along with any subsequent amendments to these terms and conditions issued from time to time and any current terms and conditions
                      applicable at the time of submitting this case to the courts.
                      5. On [Insert date of T&C Letters]. The claimant also requested a detailed report of which clause, ??
                      in the terms and conditions, each charge had been applied against,
                      but to date the defendant has have failed to do so. (Delete this paragraph if they have supplied them ?? sorry I havent requested them. do i need to??
                      6. [if you have received the terms]The terms and conditions of the account contract explicitly describe the charges as to be levied in instances of breaching those terms and conditions.
                      This is highlighted on Appendix xxx and states:
                      ‘Charges:If your account remains out of order future transactions may be declined,
                      your credit limit may be reduced and the following charges may be applied to your account
                      if you continue to break the conditions of your agreement’ [amend to suit wording from your T&C's ????

                        Hi Flangies,

                        I can see you are having problems with the N1.

                        Sorry I can't help this evening but will be able to spend some time with you on this during the day tomorrow. If it helps please have a look at my own Capital One claim thread. Fairly early on in the thread I posted up the POC that I used.
                        I would propose a few basic tweaks to that POC and will do that for you in the morning.

                        Sorry I can't do much tonight.

                            I have had a long long read of your threads and battle with Cap One, oh my goodness how patient are you? Dont think I would ahve the energy to go down the same route as you lol. well done you x

                            I am now very confused with the NI/POC and the one on the site is different to your one.

                            I am confused as to the part saying about the terms & conditions as I havent requested any; should I be? and the daily rate? sorry if I sound dim..........

                            Anyways if you could give me a little advice of how to get to the next stage it would be very much appreciated. If I could file the NI as soon as possible it would be advantagous.
