If you have sent a full SAR then they need to furnish you with more than simply a list of charges applied to your account(s).

You will have (presumably) requested all the information they hold on you - this is what they need to supply you with and they should not be trying to pre-empt your reasons for doing so.

Here is some info on the subject access request you are waiting for Legal Beagles
It gives all the details of what to do and the time scales and what you do if they don't adhere to the time scales.
Have a read at your leisure, I find if you get to know a little about what you are doing with your claims and why it does help.

              Re: Flangies v Capital One

You can't claim the annual fee.
not sure about the AMF earned charge off. Cash interest and Purchasse interest - , you claim a proportion of interest on the spreadsheet you send with your claim.
You can claim all the others though.

Just to clarify that I can claim back Return cheque fee, payment reversal & return payment overlimit def fee & direct debit return fee? as I have been told you can only claim the charges for £12?

                    Re: Flangies v Capital One

Claim all the charges, £20 and £12. Crap One will fob you off about the £12, and say thay are allowed to charge this. This is basically the figure that the OFT said they wouldn't take any action on. When push comes to shove Crap One will back down. Because you will send them a copy of the OFT guidelines about the £12, after you've recieved their fob off letter. Then you will file at court and they will give in. That's what usually happens anyway. And I work on the premise "if you don't ask you don't get"

                      Wendy
                      Thank you - you state all £12 & £20
However I have charges as below; so can I claim all these listed below besides the £12 & £20??

                      Overlimit fee of £12, £18 & £20
                      Rtn Chq fee £15
                      Returned Payment Overlimit def £12.00
                      Direct Debit return fee £20.00

Sorry to keep asking; I just want to get it right before sending the next letter

                        Re: Flangies v Capital One

Yes. Claim them all. Put them all on your spreadsheet. If they are on you can always take them off (though you won't have to). If they are not on it would be a pain to add them on later.

Claim everything then argue about it if the need arises.

                          Re: Flangies v Capital One

Also request the "purchase rate of interest applied to the charges" (as they have charged you interest on your charges haven't they?) this is in addition to the statutory rate you will be requesting on the Court Application.
The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

Which spred sheet are you using for interest calculation?

You are probably paying 30% interest on your charges, so this needs to be refunded as part of your claim (and they will). Once you serve court papers on them (which you will have to ) from my expierience they will inform the court that they intend to refund charges plus interest taken as a result of these charges plus costs plus statutory interest which will be their defence, however if you do not ask for the "purchase rate interest" they will not include it (why would they?).
