After losing an appeal for non payment of Congestion charge, I wrote in for an independent tribunal decision. This decision was delayed due to the numbers of appeals being heard. I never had a letter of losing the appeal at any point. Next thing I knew was a letter from TEC @ Northampton County Court informing me of Warrant of Execution issued to (un-named) Certificated Bailiffs. Total outstanding amount £202.00. I then received a note from JBW Ltd asking for £215.44 & on Monday 27th January I called them to make a part payment of £115.44 which was accepted. I also explained that I would be unable to pay the balance until the end of the month due to my financial circumstances. At 03:15 am on Tuesday 28th January, my stepson noticed a small blue van near my car & a man putting 2 notices on it. He then drove off. I collected the notices that stated " Warning: This vehicle has been immobilised & lawfully distrained, seized (levied upon) & impounded in execution of a Warrant of Execution or a Liability Order or Distress Warrant. " It then gives a gentleman's name & mobile number. It did not identify my vehicle (which is on finance)by registration number, nor my name or address etc.
Nobody knocked at my door or operated our intercom system. No wheel-clamp was attached to the vehicle at any point. I telephoned the "bailiff" at 04:10 & he said that I would be required to pay £345:00 to have the clamp removed & cancel any further action. If this didn't happen my car would be removed later that same day. explained that I had made a payment to his office the day before but he insisted the full amount was now outstanding. I further explained that my father was in hospital gravely ill & I needed my car to go to the hospital in an emergency if needed, a trip of 30+ miles from my home. He said he would see what he could do & would call me back later. Unable to sleep any longer, I waited for his call which came at 07:30. He said that he had asked for the (non-existent) clamp to be removed so that I could go to the hospital if needed. I moved my vehicle to my garage where it remains. I called JBW Ltd from work, but they would not accept any further payment referring me to the bailiff concerned. I have had no further contact with him, until I again contacted his office today 30th January. I again tried to pay the true balance of £100:00 that I have borrowed. They put me on hold & transferred me to the bailiff on his mobile. He asked if I was able to pay the £345:00 & that the companies ANPR vehicles are now operating in my area & will clamp and/or remove my vehicle when found. I again explained that I could not pay the £345:00. I have had a message from his office stating the same on my home phone also. I have been told that removal fees would add another £300 -£450:00 in costs. I cannot afford the sums being mentioned nor can I be without my car due to my fathers declining health & the need to go to the hospital with my mother.
I contacted the Traffic Enforcement Centre who have now emailed 2 forms for me to print off, complete & get witnessed at the local Magistrates Court, then return. These are for the non-receipt of the appeal decision I understand.
How should I proceed please. I am scared to use my car at the moment just in case.
