    After losing an appeal for non payment of Congestion charge, I wrote in for an independent tribunal decision. This decision was delayed due to the numbers of appeals being heard. I never had a letter of losing the appeal at any point. Next thing I knew was a letter from TEC @ Northampton County Court informing me of Warrant of Execution issued to (un-named) Certificated Bailiffs. Total outstanding amount £202.00. I then received a note from JBW Ltd asking for £215.44 & on Monday 27th January I called them to make a part payment of £115.44 which was accepted. I also explained that I would be unable to pay the balance until the end of the month due to my financial circumstances. At 03:15 am on Tuesday 28th January, my stepson noticed a small blue van near my car & a man putting 2 notices on it. He then drove off. I collected the notices that stated " Warning: This vehicle has been immobilised & lawfully distrained, seized (levied upon) & impounded in execution of a Warrant of Execution or a Liability Order or Distress Warrant. " It then gives a gentleman's name & mobile number. It did not identify my vehicle (which is on finance)by registration number, nor my name or address etc.
    Nobody knocked at my door or operated our intercom system. No wheel-clamp was attached to the vehicle at any point. I telephoned the "bailiff" at 04:10 & he said that I would be required to pay £345:00 to have the clamp removed & cancel any further action. If this didn't happen my car would be removed later that same day. explained that I had made a payment to his office the day before but he insisted the full amount was now outstanding. I further explained that my father was in hospital gravely ill & I needed my car to go to the hospital in an emergency if needed, a trip of 30+ miles from my home. He said he would see what he could do & would call me back later. Unable to sleep any longer, I waited for his call which came at 07:30. He said that he had asked for the (non-existent) clamp to be removed so that I could go to the hospital if needed. I moved my vehicle to my garage where it remains. I called JBW Ltd from work, but they would not accept any further payment referring me to the bailiff concerned. I have had no further contact with him, until I again contacted his office today 30th January. I again tried to pay the true balance of £100:00 that I have borrowed. They put me on hold & transferred me to the bailiff on his mobile. He asked if I was able to pay the £345:00 & that the companies ANPR vehicles are now operating in my area & will clamp and/or remove my vehicle when found. I again explained that I could not pay the £345:00. I have had a message from his office stating the same on my home phone also. I have been told that removal fees would add another £300 -£450:00 in costs. I cannot afford the sums being mentioned nor can I be without my car due to my fathers declining health & the need to go to the hospital with my mother.
    I contacted the Traffic Enforcement Centre who have now emailed 2 forms for me to print off, complete & get witnessed at the local Magistrates Court, then return. These are for the non-receipt of the appeal decision I understand.
    How should I proceed please. I am scared to use my car at the moment just in case.

    Have you informed the prats at JBW that the car is on finance? So long as it is HP or a lease type agreement then they cannot lawfully seize it. I would inform them of this as it looks like they have levied soley to garner fees as you had already paid something off. Fill in the forms regarding non reciept of appeal result to TEC. All the fees associated with the levy must be removed, so you will have to provide JBW with the proof of finance.

      Hi, thanks for the response. I have informed the "bailiff" directly that the vehicle is on his finance. I'm just worried about them spotting the car out somewhere & lifting it, so I'm keeping it garaged. But this is causing me a lot of stress at a difficult time.

        The levy was invalid anyway, as it did not identify your vehicle. And as its on finance, if they did sieze the vehicle then inform the finance company, as they will then pursue JBW directly.

        You should make a formal complaint to JBW about the bailiff and them refusing to allow you to pay the real remaining balance and about the unlawful fees applied.

        Also is the bailiff that is dealing with the issue on the registered or certified bailiffs? - http://certificatedbailiffs.justice....catedBailiffs/ - If not add that to your complaint to JBW the bailiff not being certified and report it to the ministry of justice too.

          I have checked the register & he is down as working for Phillips Collection Services Ltd. His certificate was issued in June 2013 by Edmonton County Court. Can my local County Court witness the PE2 & PE3 forms for me? Will that prevent further action by JBW?

            I just noticed that the notice put on my car was placed by a Mr. Erbil. Searching the bailiff register names an Erbil Erbay. So this person has not even named himself correctly on his notice. Could that be used as a technical error with the paperwork?

              Is the bailiff's name Mr G Erbil, by any chance? You could have some fun and wind this bailiff up no end ringing him and asking him if he is "Mr Gerbil"

              Joking aside, this bailiff and JBW are skating on thin ice, in the legal sense. JBW have form for seizing third party vehicles and costing local and public authorities a small fortune in compensation and legal costs through their bungling incompetence. This is one of the reasons JBW is sometimes referred to as "Jamie's Brainless W*nkers", the "Jamie" reference being JBW's MD Jamie Waller.

                I'd say it looks like more than a mere "technical error", as it is hardly likely that he would forget his own name.

                It looks more like fraud !

                Suppose that you had the name of Joe Soap. Can you imagine how you might innocently sign a legal document, declaring yourself to be Mr Joseph?

                Another point that may be worth noting is that his former employer, Phillips Collection Services Ltd, was bought up by Serco and was renamed Collectica. As that company is not noted for an entirely unblemished record, one might asked if he quit or was he pushed out, for being too bent even for them?

                  Check with Edmonton CC that Mr Gerbil has informed them of his change of employers. If he has not, Edmonton CC won't be happy bunnies. Certificated bailiffs are required to inform the court that issued their certificate of any change of name, address and/or employer.

                    I have tried to deal with JBW'S office to pay the original balance of £100.00, but they won't accept it. I spoke to them yesterday again offering the same amount but was told that it will not be accepted. I need to speak with the bailiff (unnamed) directly. I received a poorly photo copied notice through the letterbox, my wife was home but nobody rang or knocked on the door. A signature at the bottom of the notice was clearly tippexed over someone else's name. I again called JBW telling them I was recording the conversation at which point the lady explained she didn't give me permission to record her voice & hung up the phone. I have now received 2 text messages telling me that their ANPR vehicles are operating nearby & Will seize my vehicle.The second states bailiffs are in my area & may attend to remove goods. I have been in touch with TEC & have an appointment at Lambeth Magistrates Court tomorrow to get PET2/PE3 forms witnessed before emailing. What should I do now.

                      If they turn up to take the car (which is unlikely as its more likely to be hot air), call the police and inform the police of everything and show them the levy is not even valid as it does not even have your cars details on it, and that the vehicle is on finance and therefore owned by the finance company, so can not be levied in any case. Show the police the finance documents. Point out the fraud, wrong bailiff name, on the levy etc.

                      Also have you spoke to the finance company about all this? If not then do so today, they can then act on it.

                          My full name is double barreled, the un-edited version is: Sir Vere Brayne d'Emmidge de San Atorium.

                          When working for Kent Magistrates I used to enter my name on alll forms as Sir Vere....as long as one can identify the bailiff and make contact with them, i.e. a mobile number that's enough!

                            Whilst the anecdote is certainly amusing, it remains a fact that the document bears a false or potentially misleading name.
