Do you yet have a full breakdown of the fees?

Once you do, you should claim back the excessive and bogus fees from the council.

And then publicly expose Rossendales for the bullies, blackmailers and fraudsters they are.

Re: Rossendale bailiffs &council tax HELP

hi all, i needed some time away from this situation yesterday to catch my breath i appologise.
firstly today i am writing a letter to Rossendales to request copy of "VALID LEVY" and full breakdown of fees.
I am making a formal complaint to the council as i have it on a recording where she agreed that the levy was not vailid and waved the levy fee then re added it later although the levy was still invalid. I believe that they re added this fee because they knew they had to stand their ground as they and i knew that without that valid levy the fees where invalid and fraudulent .
I need to seek assistance in writing formal complains to council and to Rossendale as i have no idea how to word this affectively ,concisely and to the point with a clear inventory of all the rules broken.
The bailiffs firstly used an aggressive bullying manner throughout even though i have clear proof that i offered full payment from the first day they hand posted the note. They knew of my illness and stated "not my problem". they left me over the weekend waiting worried and anxious. And then continued on their tirade through out the day backed by the council !
after all my family and i have been put through i refuse to let them still get away with blackmailing me into believing if i didn't pay up they would take a complete strangers car ! i have had to go to my neighbours on the bailiffs command and try to find out whose car that was on the levy as they believe that without any proof of whos car that is they could take it ???
i have pictures to show that the car could not possibly have been outside my house and i am pretty sure the bailiffs procedures say that they should act with discretion . they have clearly chosen a random vehicle off the car park and claimed it to be mine !
Once i have have found someone to help me write these letters they will be sent and complaints will be made they have robbed me bullied my family and broke the rules simple.

Received full breakdown of fees and copy of levy which they did not bother to post as I believe they should have . "Valid levy" is indeed invalid as its one of my neighbours cars ... Let the games begin !

Re: Rossendale bailiffs &council tax HELP

I have returned with my outcome so far.
I sent a letter of complaint to Rossendals and waited 2 weeks for a reply which stated that the bailiffs had responded with a claim that I had asked the to remove their ID for my inspection! obviously a case of he said she said ....... this is a complete fabrication obviously to defend themselves to their employers.
secondly Rossendale stated that they would further contact me in 20 days in which time they would check with the DVLA the ownership of the vehicle levied.
I received no reply after that so 25 days on I send an email simply telling them that i was not satisfied with their "investigation" and I believe the silence was due to them finding out that I was in fact telling the truth and did not own the car that they levied. I also said that I would not contact them again on this matter as I will be escalating the matter.
I today received a letter of apology saying that they are sorry for taking so long and it is true that I do not own the car which they levied so will receive a refund of £151.00 they are also sorry for any inconvenience caused.
so in a nut shell they can do as they please .....if you stand up to them you may win and prove that they are lying rats out to get what they can from people who are obviously already in a poor financial place. or let them take you for all you have and quietly hate them.
I myself am not happy with this outcome. yes its true I proved my point and got back the money I already worked for 2 months ago and that rightfully belonged to me.
however in taking it they caused me stress, I lost my car because I couldn't make the payment that month and couldn't pay double the month after.
I intend to make it known that bailiffs in general are a bunch of glorified debt collectors that think they are above the law and everyone else.

Any mileage in a claim for consequential loss due to the unlawful levy by the bailiff?

The assumption is they would refuse, the only other solution might be via an N1.

Is it serious enough for a Form 4? Alternatively, I think the County Court is the only way to get true justice.

What hasn't been said yet, and I'm sure we would all want to say is a huge well done to Karen for sticking to her guns. I know from personal experience how difficult this is when you have their threats hanging over you all the time.

Hopefully the refund will bring some sense of justice having been seen to be done, but there is more to go IMO.
