    She was recovery did not give much else away and no one seems to want to help me find ssomeone who can/will help.
    i simply want to pay the bill with legal fees and not have to deal with these bully's anymore however no one will take it I get referred back to the bailiffs repeatedly the people who are doing this to me !

      Whilst it is only a report and cannot be forced upon Councils it does make the Council feel uncomfortable particularly if you have engaged you local Councillor(s).
      I believe it might be used by a local Councillor to highlight malpractice by Council employees and to support a motion to dock the pay of the Head of Revenues appropriately.

          Just a though for discussion.

          Could Karen get an N245 (application for suspension of a warrant and/or variation of an order), & use that as a mechanism to bring these sods to task?

            i just rang the ombudsman and spoke to one of the gent that takes complaints I explained all of this and that the amount of calls for help I have made this morning to no avail have left me feeling so alone I ended with calling my doctor. The LGO cannot get involved until you have exhausted a local authority's complaints procedures. Once that has happened and a complaint remains unresolved, then the LGO can become involved.
            he said I have a number on grounds for complaint and to put in in writing as soon as I'm able and well enough to. At least the LGO has acknowledged Rossendales and your local council have trangressed. Rossendales have come in for scathing criticism from the LGO in the past and have featured in a number of cases the LGO has dealt with. The most serious case involved Blaby Council and Rossendales are lucky their bailiffs and senior management did not face criminal prosecution over what they allowed to happen.

            i have no idea if he will but so far no one else other than this forum seem to care. If it appears to Eric Pickles your local council have ignored his public statement about the use of bailiffs by local authorities, I cannot see him being too happy. I understand he was a local councillor before he became an MP.
            it appears bailiffs can be let out to do what they want when they choose with very llittle consequence ..That situation will only persist as long as people say nothing and do nothing about it. Once people start making a lot of noise and start giving bailiffs a hard time, the situation will start to change. Police officers, up to now, have acted in blissful ignorance, but the honest majority of police officers do not agree with the way in which bailiffs conduct themselves and would welcome instruction on what they can and cannot do. Do not judge these honest officers on the behaviour of the corrupt and incompetent minority.

              Not applicable N245 is for County Court Bailiff & Variation of a CCJ.

                    I have gone over this from the beginning trying to establish what has happened.

                    What is not in doubt is the original amount of money owing or the 1st Visit Fee of £24-50 listed on their documents on 29 May making a total owing at that time of £201-52.

                    The next date you have is a letter dated 12 June listing the same amount owing - was this letter delivered by hand or via Royal Mail? I ask this as there does not appear to be a claim for a 2nd Visit. Also with this is a blank inventory/walking possession, proving at this date no goods had been seized.

                    The next date you have provided is 27 June where the amount they are claiming has risen dramatically to £370-57 - an increase of some £169-05. Unless it is something you have not given us sight of there still does not appear to any sign of a valid levy on YOUR goods. Also there is no breakdown on this paper of the fees that have been charged. It appears that the Bailiff is insistent that a Van Fee has been applied.

                    The object of a visit from a bailiff collecting for Council Tax is to attend with a view to seizing goods to satisfy the debt. For this he is allowed to make a 1st Visit Fee of £24-50 if he fails in his objective. He may visit again and if similar happens he is allowed to charge a 2nd Visit Fee of £18-00. After that he may visit as many times as he likes but if he does not have a valid levy on your goods then he may charge no more. If he is able to make a levy on your goods then he is allowed to attend with a view to removing those goods but must have the correct equipment to do so. If removing a vehicle then he cannot just turn up on a push bike.

                    What I cannot quite make out from what you say is whether they have made a levy on goods owned by someone else assuming they are yours. If this is the case then you must inform them of this ASAP. They may ask youto prove this but in all honesty how can you prove you don't own something. If it is for a vehicle then it is for them to do a simple DVLA check.

                      You say you have been given the run around by the Council and they also say you must pay this van fee. Basically the Council are talking rubbish. What you must do ASAP is send off for a breakdown of the fees they are charging you. Use Letter 1 from http://www.legalbeagles.info/forums/...Useful-Letters and send initially by email enquiries@rossendales.com followed by a letter in the post.

                      As has been said previously by myself & others you should involve your local Councillor(s), details may be had from Council website or phone them and ask.

                      You mention you may be vulnerable. Unless you can provide proof of this - letter from GP for example, then I'm afraid they will take no notice of you.

                        Can you believe they still havnt even collected this payment ! Today I am paying the outstanding debt direct to the council office although they refused the bailiff fees, they will just have to collect their fees when they get a minute away from extorting the poor and vulnerable !

                          Having texted bailiff to find out when he is collecting payment I received following text:

                          having spoken to the council - we gave you until yesterday to get your proof in as you have not done all fees stand and we will attend today to collect full payment or remove goods. Thanks

                            you have missed nothing, the CT debt and first visit is not under dispute I offered to pay this repeatedly... It was refused.
                            they only paperwork I received after LEGAL fees where stated is the HAND DELIVERED sheet from 2nd bailiff stating I owe 370.52 THIS IS ALL not even a levy proof has been posted or handed to me for RANDOM VEHICLE . Bailiffs have acted in bullying manner and I feel intimidated by him and his partner and although I have asked them to collect monies they have dragged this out over 5 days with no valid levy nor a valid reason to refuse payment of 219.52 which is legal debt and fees.
                            i100% believe that they are going to have to try get a valid levy on goods to redeem themselves and I'm scared.

                            i replied to above text from bailiff :
                            Ok I have recordings of ALL conversations that took place yesterday with myself and you and the council in none of these was it stated that I had 24 hours to provide proof of ownership on a random vehicle. However I did try, the neighbour I believed owned that registration has told me its not off his car I believed it to be a vauxhall Astra but it is not same reg therefore I do not know who's car you levied therefore I could not possibly provide proof of something I know nothing about.Having said that I do have full payment of 370.52 which you are welcome to collect at your convenience ttoday's am going to have to call the police station for help I can't get it any where else and I feel like a sitting duck !! I want to pay this bill now !

                              This bailiff is seriously pushing his luck.

                              It is tempting to advise you to text the tit back and remind him he does not have a valid and lawful levy and, therefore, he can only collect two visit fees, totalling £42.50, at most. He also needs to be warned that any threats in connection with fees he is not legally-permitted to charge carry serious legal consequences for him and Rossendales.

                                He know this I have previously warned that what he is doing is illegal , he does not care I just want him to take the money I am shaking all over I can't take anymore I will have to give him what he wants anything after that I will call the police for harassment .
