    According to the council they ARE LEGEALY CHARGING ME FOR THE VAN THEY HAVE WAVED THE LEVY FEE AND I HAVE TO PAY 340 today !

      Hi Karenj,

      If there is no valid Walking Possession Order (levy), they cannot remove goods, so there is no need for a van, or a charge for a van.

        I don't even know what to do anymore they say that the van is a standard fee the bailiff was sent to collect full payment or goods to that value the van fee is standard to carry that out.
        but surly does this mean they charge every household 140 each for this van how many people do they visit in a day ??? 10 would mean they collect £1400 per day for driving the van around ??? Weather they collect money or items its a lucrative set up

            They say I had chance to pay when the guy visited on the 29th may but I chose not to , this wasn't the case he told me to call council tax and sort it out with them , I wish I had recorded it now . But I didn't , I also wish I'd have just paid it then too but I forgot and as much pressure as I'm under at the moment this could be looked on as my own fault but surly they can't legally charge for this van when they waved the levy fee therefore admiring no valid levy. The one they have is on a neighbours car they picked at random and he said it was out sue my house when that's not possible there is no road outside my door only a residential car park that u must go on foot to access

                  Yes the telephone call is recorded with the reg I called rossendale direct they told me what the levy was on. Then I have a recording of bailiff where I asked why he was under the impression that was my car ? It's my neighbours (everyone knows everyone on the court) he says "he would of asked a neighbour" [quote] j shaw.
                  My neighbour is now aware or what has happened I have spoken to him.

                    As no Notice of Seizure seems to have been left, there seems to have been no proof of that alleged levy.

                    As for the demands by the council muppets for the "van fee", it may be wiser to pay the buggers and subsequently claim the excessive fees back from the Head of Revenues, possibly escalating the complaint to the Local Government Ombudsman.

                      it appears to be my only option. i may have to keep the recordings from thread until i have cleared my complaint as not sure on legality's surrounding this
                      and posting these?
                      even telling them that i have mental health issues and currently on medication resulted in an "i dont care reply"
                      i cant deal with this properly while i feel like this so have decided to pay in full and deal with them later

                          You may wish to inform the council that the Council Tax (Administration & Enforcement) Regulations 1992 (as amended) do not allow bailiffs enforcing CT arrears to charge van fee unless they are lawfully removing goods. If he/she insists they can, ask them to put it in writing and sign the letter. That way, you've got them by the short and curlies as well as the council.

                          As Charitynjw and Clever Clogs have said and I am now saying, the bailiff has no lawful or valid levy and has not lawfully levied on goods. The van fee is, in the circumstances, fraudulent and, consequently, illegal.

                          As for your mental health issues, this means you fall under the National Standards for Enforcement Agents which all councils and bailiff companies have agreed to abide by and have signed to this effect and are classed as vulnerable.

                            Have a read of the LGO Focus Report from last November http://www.lgo.org.uk/news/2012/nov/...half-councils/ - if yougo towards the top right of the page & download the actual report you will note what it says in "Case Study 5 - inappropriate Van fee". The rest of the report may give you some other help also.

                            Whilst it is only a report and cannot be forced upon Councils it does make the Council feel uncomfortable particularly if you have engaged you local Councillor(s).

                              How would I get his email address ? I have looked it up. I also have recorded lady at council telling me that they can still charge for removal of I levied goods and I must pay them in full. She also have stated her name for me.
                              i just rang the ombudsman and spoke to one of the gent that takes complaints I explained all of this and that the amount of calls for help I have made this morning to no avail have left me feeling so alone I ended with calling my doctor.
                              he said I have a number on grounds for complaint and to put in in writing as soon as I'm able and well enough to.

                              update. Emailed Eric pickles for help.
                              i have no idea if he will but so far no one else other than this forum seem to care!
                              it appears bailiffs can be let out to do what they want when they choose with very llittle consequence .....
