Council Tax Bailiffs

Hi im just wondering what legal rights and where i stand regarding Equita ( council Bailiffs )

To cut a long story short, I recieved my council tax bill for this year on the 18th March 2013, which also stated i owe £189.16 for other years meaning last year, I phoned them up a couple of weeks later to try and pay in installments they told me it was out of their hands and has been refered to their Bailiffs 2 days prier, they gave me Eqita's phone number to which i phoned them.

Equita gave me mobile phone number of the person dealing with my debt, to which he stated the amount is the amount i owed i have no entitalment of paying in instalments its amount in full or the removal of possessions, i had no letters prier to this which he states i had, 2 days after my phone call to them i recieve a removal notice to which i phoned them again they wanted payment in full so i rallied around and got the £189.16 phoned him up the next day because he failed to ring me back, a man in a suit turned up was just about to pay him to my horror he had a red Bailiff Removal Final Notice letter with the sum of £427.66 to which i didnt pay anything shut the door and phoned Lee up again managed to stall him till Friday last week got the rest of the money together leaving me way short, to this day they still havnt showed up. I have now sent Equita your usefull letter No 1 and was wondering if i am doing the right thing and what happens next as i have sent the money back to the loan company as your threads say not to pay bailiffs and not to open or let them through the door.

Hi as far as i know i was not aware the council had a liability order against me, Yes i think i have read this but cant check at the moment as the link doesnt seem to be working.

You need to speak to someone at the Council and ask the following questions:
1 - how many Liability Orders they have against you
2 - the dates they were obtained
3 - the addresses they were for
4 - the period of time each covers
5 - how much each one was for
6 - how much is still outstanding
7 - the dates they were passed on for enforcement
8 - the dates & amounts of any payments

The feess he has quoted are all wrong. Equita when questioned about their fees now appear to state they are "potential" fees and not those actually incurred. To me that reads we have charged these fees and as long as you don't challenge them we have got away with it - enough in my mind to make the management complicit in blatantly overcharging.

If he has not made a visit then you owe no fees at all. If he has made 1 visit and providing he has not made a levy on any goods then he may charge £24-50. If he makes a 2nd visit with the same outcome he may add an extra £18-00. No matter how many more times he visits he may charge no more providing he has not made a levy. Usual trick is to levy on a random vehicle near your home whether you own it or not but that is easily dealt with.

He has made one visit which was on Monday 1st April and should have been back on Friday 5th April but no one came round, there are 2 cars on my drive but they are not mine and i dont own them.

He may well infer he has a levy on them, but as they are third party, you could quote the LGO report into Blaby council and Rossendales ltd regarding levy on cars not owned by the debtor.

Trouble is, bb, they aren't issued with light sabres, though, I understand getting whacked by an asp does hurt somewhat. A record that was out in the 1970s entitled "Can You Feel The Force?" comes to mind. Equita certainly will "Feel The Force" if they carry on behaving like they are.

Trouble is, bb, they aren't issued with light sabres, though, I understand getting whacked by an asp does hurt somewhat. A record that was out in the 1970s entitled "Can You Feel The Force?" comes to mind. Equita certainly will "Feel The Force" if they carry on behaving like they are.

Equita may well Snap, when they realise they don't have "The Power" then when a coopper tasers the bailiff, with 5000 Volts, he will cry "I'm on fire"

I think you'll find a Cap-Chur rifle armed with a tranquilliser dart will be needed to bring a certificated bailiff down, bb, as most of them are so huge, they probably have the hides of rhinos.

Perhaps a track the Mike Post Coalition on an adjacent stereo coming through an open window, could be playing as they tranq the bailiff "Afternoon Of The Rhino"

If it was around these parts, the local anklebiters would be chucking half enders and stones at the bailiff also or riding their bikes at them, or having a soakathon as they attacked the bailiff with super soakers
