    Ah well a waisted time down at the council offices, wouldnt budge and wont take the debt back, once it has gone to the bailiffs it is out of their hands and they can not get it back, have been advised to write back to Equita over the dissagreement with the levy fee and that is that, so its off to write to Equita again requesting a copy of the Form 7 notice of seizure and the date that it was supposed to have been issued.

    Oh and the reason she came back with over the drop in debt amount ( £427.66 down to £242.66 ) was someone wrote it down wrongly but they have realised their mistake and corrected it, had i have not challenged them i suppose someone would now be £185 richer lol, she had no answer to that

      You were likely speaking to a crapquita drone, and it is strange how these council offices make mistakes try to make you pay up, then miraculously remove the fees isn't it?

      As to not being able to recall the account, the council remains in control of the account at all times, and cannot sell transfer or otherwise demise the debt as in sell it on like a DCA to the bailiff whatever they claim.

        I have not a clue as to who i actually saw but was meant to have been someone from their recoveries dept, who actually said that the debt gets passed over to the bailiffs and is then contracted out for collection so they can not get the debt back, i did challenge her but to no avail she just would not budge.

                OMG the bailiffs turned up today ( i did not open the door ) BUT they have now levied on my boyfriends car and clamped it, he needs his car for hospital and Drs appointments as he has Crohns desease both him and my 3yr old son who is asthmatic have Drs appointments on Thursday, I have phoned Lee the bailiff up to put him right on the fact he ballsed up on the notice he served on the car which stated it was for non payment of a parking ticket and also the fact that the car is not mine and they have clamped it causing alarm and distress to the car owner, i am now waiting for him to come back round to declamp if they do.

                  He needs to send a copy of his proof of ownership or swear a Stat Dec and send it to the bailiffs and the council, copy to CEO, along with a Formal Complaint as you are now, due to Asthmatic child, and BF with Chrohns firmly in the vulnerable category under the National Standards.

                    He has them to hand as they will not declamp without proof but that was 1hr 30mins ago and they still have not turned up

                      Crohn's Disease can be very serious. The bailiff needs to get their ar$e into gear and remove the clamp PDQ. Any attempt on their part to remove the car will render them liable to prosecution for Theft. They and the Council are already liable to civil damages for Unlawful Detention of Goods and Trespass Against Property, plus Loss of Use and any expenses incurred due to the loss of use. If your OH can afford a solicitor, a solicitor's letter to an LA over unlawful/illegal seizure of goods can and often will bring about a very rapid change of attitude.


                      If the bailiff who attached the clamp turns up to remove it, obtain his details, including the name of the court that issued his certificate. I would advise making representations to the CJ or DJ at that court as to his actions.

                        As I remarked earlier, that is utter nonsense.

                        Read Regulation 70 (link) of the Local Authorities (Contracting Out of Tax Billing, Collection and Enforcement Functions) Order 1996 and quote it to your local councillors whom you are going to contact tonight. All the local authority needs to do is to tell the bailiff company to stop acting like thugs and the company must comply.

                              He will be in no hurry to come and remove the clamp, he will either be harassing another debtor or be down the pub now. You need to phone the councillor now and give him grief, explain the vulnerability issues, the illegal siezure
                              ant the fact that Crapita are infesting the council and causing problems. Tell him Crohns can be extremely serious, and also if your child has an asthma attack and you have to wait for an ambulance rather than using a car the consequences may well make Crapquita look like heartless barstewards, and also bring the council very bad publicity.
