The feess he has quoted are all wrong. Equita when questioned about their fees now appear to state they are "potential" fees and not those actually incurred. To me that reads we have charged these fees and as long as you don't challenge them we have got away with it - enough in my mind to make the management complicit in blatantly overcharging.

If he has not made a visit then you owe no fees at all. If he has made 1 visit and providing he has not made a levy on any goods then he may charge £24-50. If he makes a 2nd visit with the same outcome he may add an extra £18-00. No matter how many more times he visits he may charge no more providing he has not made a levy. Usual trick is to levy on a random vehicle near your home whether you own it or not but that is easily dealt with.

Ok, have just recieved a reply letter from Equita and surprise surprise the amount owed has gone from £427.66 down to £242.66
Here's how the letter goes
Having looked at the case i note that no times of visits have been logged, there have been numerous visits made by our external team in the attempted collection of the debts. On each occasion, where no contact has been established, a letter would have been left.
STATEMENT
liability order date 06.08.2012
Debt £189.16
statutory visit fees £ 24.50
Levy Fee £ 29.00

TOTAL £242.66

Total received £ 0.00


BALANCE £242.66


I can confirm that our enforcement bailiff Mr Lee Dubois was certificated at Bromley County Court on 11th March 2013. Your file remains with Mr Dubois who should be contacted on .............. . Your account may be subject to further costs.

So I phoned the council to see if they would take the debt back and have been told i have to talk to their recovery dept so have made an appointment with them for next Wednesday which was their earliest.

My argument with the Council would be that you asked for a breakdown etc of your account with Equita but they have been obstructive in that they have not provided the times 7 dates of their alleged visits, have made an alleged levy on goods you know nothing about. The Total they have given is at odds to what the Bailiff originally claimed, he does not appear on the Bailiff Register. It appears therefore that you cannot trust either the bailiff or his company and you now request the all the information you asked of Equita to be provided by the Council as they are responsible for the actions and charges of their contractors.

So we need to how the onanists justify "Levy Fee £ 29.00" no levy = no levy or ATR fees, I would suspect they may claim a levy on a car, in all possibility a random motor that just happened to be around if you hadn't got one at or adjacent to your property.

He does deserve however for his outrageous demands to be drawn on a hurdle around the town, then put in stocks in the town centre, to be pelted with rotten fruit and vegetables, for not less than one day and night.

There are 2 cars parked on my drive but they are not mine, i cant drive and they certainly are not in my name

Why are they there?

Whose motor-cars are they?

Any bailiff, being a bit dim, would automatically assume that the vehicles did belong to the occupant of the house. However, they could not lawfully be removed and sold as they do not belong to the debtor.

Was a Form 7 (Notice of Seizure) affixed to either motor-car, or posted through the letterbox of your domicile?

The cars in question are my boyfriends cars who has just recently moved in with us.
There has never been a form 7 either affixed to either car or posted through our letterbox.

Why are they there?

Any bailiff, being a bit dim, would automatically assume that the vehicles did belong to the occupant of the house. However, they could not lawfully be removed and sold as they do not belong to the debtor.

Then boyfriend lays claim to the vehicles sends bailiff info swears stat dec, and bailiff goes forth to multiply, possibly, they will squeal like a stuck pig, but if he was non resident when the debt was incurred, then Mr bailiff can go swivel for his unlawful fees
