My gut-feeling is that, in the OP's case, what Barking Mad Council did it is more akin to Malicious Prosecution, which is a civil tort, and Contempt of Court, which is a criminal offence. However, if after Barking Mad Council had been told of their blundering and the court had ordered them to stop they continued regardless, then, there may well be a cause of action against Barking Mad Council and JBW under Section 3, Protection from Harassment Act 1997, citing the Ferguson case.
