Asking certificated bailiffs to produce an HMCTS ID Card/Certificate will usually have their backsides emitting tuneful sounds. They know very well they are not permitted to call themselves court bailiffs or claim to be acting under the authority of a court when they are not.

bluebottle, im not honestly bothered by them adding charges as they will not get a penny, they have not provided me with a breakdown of charges added and the paperworks with them on doesnt even have an address on, with no signature from me or the bailiff.



jbw number removed and also partners name, but no address etc so filled out wrong for a start, but they aintgetting owt anyway, just hopefully a bit of sport for me lol

As Teaboy has stated, Barking Mad Council and JBW are, at present, in contempt of court. I feel that the CEO of Barking Mad Council and Jamie Waller, who owns JBW (apparently, JBW is Jamie's initials), both need to be sent a very cold and clinical letter advising them they are in contempt of a court ruling and face action if they continue with enforcement. In the case of the actions of the bailiff who attend the OP's home are anything to go by, it does make one wonder if JBW stands for "Jamie's Brainless Wonders".

Personally i would have swapped the letters O and D in the word Wonders for A and K - As it would certainly be a more accurate discription of those that he employ's LOL

I hadn't discounted that, Teaboy. Perhaps, "Jamie's Brain-Dead W*****s" may be a more accurate description. It would not surprise me if that is what JBW's victims call them.

The best you can do is to put a notice up saying "No Bailiffs", this needs to be sited at the entrances to your property - ie by the gate or end of the drive, pointless putting it by the door as he then has to access the property to read it.

Of course I'm sure I don't need to point out the fact you'd be advertising your problems to your neighbours, as well as making the assumption that bailiffs can read.

Neighbours are fine, but ive already sent an email off to jbw stating that i have removed implied right of access to them.
I though that i could inform them verbally and backed up with a letter this would suffice?

anyway, im at the point now where the parking department has replied to me

"Your query is outside the jurisdiction of the Parking and Traffic Appeals Service. Please direct your correspondence to the Enforcement Authority concerned."

ive spoken to charles again who suprise suprise has not received my email , so i informed him that this phone call is being recorded (which it is) and he became very helpful (which he should)

he even gave me a personal email.


anyway im about to ring them back now to confirm he has the email and also i am going to get his managers name and details.

Another thing is LBBD have an option on there website where you can view the evidence on the PCN ie.e photographs and or video footage etc etc now ive tried putting my details in but it says there is no evidence with those details, i suspect as its been too long.

can i legally request the information? what if they no longer have it?

I really need the outcome of this to be a letter from one of them stating that this will no longer be followed up??

anythingi can send to them which legally requires them to provide evidence of the contravention as i have never received anything only there word?

[b] OK update after speaking to charles today he has informed me that they have looked at there information and they have made me offer........

They have offered to allow me to pay only the original fine and there own charges which amounts to some £127 and something pence.......

I have refused this, there reasoning being that with the evidence i have provided there was no change of ownership on the records at the time of the infraction , which has now been updated and amended by the DVLA to show the true owner. I asked for them to recheck as i have requested many times, he refused to on the grounds that it wouldnt make any difference. He stated that even though i had been to court and got an out of time statement and won, he stated i should of received a letter from them telling me that even though the magistrate had ruled the pcn be revoked that LBBD was intending to pursue this matter again. I told him i never received this or any more communication from LBBD the only thing that happened was basically it went quite for a couple of years and then all of a sudden letters started arriving from the different bailiff agencys.

I also requested from him that i now require from him the original evidence (copys of) of the contravention, i.e. photos / videos / original ticket from the traffic officer etc etc, as LBBD have a mechanism to view this information on line if you put a PCN number in and the reg of the car...........he stated that he will do this (freely, i mentioned that i dont want to pay for it as legally i should not have to) he stated that he will try to get the evidence but even if he cant provide the evidence this doesnt mean that where not liable. I informed him that i have tried to go online and view the evidence but it states that the pcn number and reg i put in there is no evidence with that number.

Now this is the problem i have had trying to speak to people, when i give them the PCN number they dont have a clue, because its that old they cant search for it in the system .

Now my reckoning is if they want to pursue the charge they have to provide evidence of the contravention and if they cant or dont have this evidence then surely they cant continue to pursue it? im hoping that its been deleted due to the time length?? as surely if i take them to court they have to have some evidence do they not? I told him that they cant just make stuff up and try and charge for it.

anyway the phone call got a bit heated then, in fairness i had just woke up and it makes me angry.

So in this conversation i verbaly tol charles that i remove implied right of access to lbbd and any subcontractors who work for them namely JBW and any other bailiff companys and or debt collection agencys and that by informing them this they will be tresspassing if they come onto my propertie.

He basically ignored this and said bailliffs will still attend, i informed him not to ignore this as it will be submitted as evidence should i go to court or have any other bailifs attend on behalf of lbbd. It made little difference but it did make him stumble, and i could tell his arse cheeks where puckering a bit, which was more my intention than anything else.

I also stated that jennifer no longer lives at this address which is backed up by the documents i sent to him, i.e. a statement from me saying that she no longer lives here, is not on the tenancy and i have no forwarding address for her. i asked that all bailifs be called off and stop coming here as i have already informed them that she doesnt live here. he refused this and stated that jennifer needs to write to them and they have means to check if she does infact live there, i refuted this and told him "charles you knwo as well as i know your just gonna check the electoral role, there is no other system for you to check and i am stating now that she doesnt live here and i have no forwarding address..." he said fine but ntil she writes to us they will still attend......in the end i hung up.


So where do i go from here, i want to see the evidence and i also want to make the bailiffs stumble, im ready for them now and am not fased at all by there bullying tactics, the first thing i will warn them is that they are tresspassing and i have a dog, any forced entry will result in the dog being not a happy chappy and should they want to continue any course of action theys hould do so from the public highway and call the police to attend with a dog handler. If they have a warrant the police should have no problems attending to enforce it..................


but please anyone, can you give me some indication as to what to do now, i.e. SAR? formal request for evidence? how do i go about it?

Just another point, but wouldn't it be worth throwing the ferguson v british gas trading limited case law at LBBD after all, they are responsible for the actions of their appointed representatives, and as the court revoked the order, then surely said case law applies here too.

Well ive just emailed charles back and requested that even though i intend to refuse there offer of paying the debt i would like to have the offer in writing or at least in email for my records as evidence and i also requested that all evidence should be made availible to me, i also require that i could do with charles managers name, email address and contact number so i can direct all further communication to them rather than charles.....................


not 5 minutes after i sent this, i got this email, in response to my spamming of certain LBBD email addresses....Corporate Complaints Team; 3000Direct ; Parking; patas.team@patas.gov.uk.

Dear Ms XXXX,

Thank you for your e-mail below. We have contacted the Parking Section and given the time lapse and circumstances of the case, the PCN and associated action has been cancelled.

We are sorry for any inconvenience or distress this has caused you.

I have just replied thanking them and that if possible could i have a written copy sent to me in the post detailing this so i have something to give to the bailiffs / charles etc etc.

Seeing as Barking Mad Council were in contempt of court, they didn't have a lot of choice. I am somewhat disturbed that Charles decided to behave like a moron, despite being aware of the fact that a court had told the Council to stop. Good result.

Forward a copy to charlie boy and demand an apology from him in writing for his negligent actions and contempt of court that led to yourselve being harassed in breach of the protection from harassment act 1997 for which his organisation is liable for as per case law of ferguson v british gas trading limited.
