    Hi guys, sorry its been a while but have been very busy with work.

    Here's an update,

    Bailiff called and levied on the car.
    I emailed a complaint to karen fowler of Equita (CC'd the CEO of council) stating that the bailiff had levied on the car which does not belong to us and also pointed out that the bailiff had taken it upon himself to add £255.50 charges on the levy (this was not broken down in anyway).

    I've today received a letter from Mrs Karen Fowler (dated 30th Nov).

    In her letter she says that they 'have been tasked with the responsibility to collect your arrears on behalf of the above named council and unless you make the appropriate arrangements to clear the amounts which currently total £xxxx.xx we will have no alternative but to instruct our removals team to attend at your premises.

    To try and assist you reducing the balance I have temporarily suspended all bailiff action until the 8 December. By that time you are required to contact our call centre with a suitable payment proposal.

    I have noted your comments regarding the ownership of the vehicle identified by Mr Williams and in turn made the necessary adjustments to the fee structure. The above balance reflects this. I can confirm however that there is no obligation for checks to be made prior to a levy being made.

    Anyone any good at interpreting bailiff scum letters???

          You are paying the council direct so none of this really matters since there is nothing they can do.

                  Update,

                  I emailed Mrs Kareen Fowler and told her their bailiffs wouldnt be getting access to our premises and to once again request a breakdown of all charges added. I also asked her to confirm that the levy has been removed and here is her reply...

                  I write in response to your email sent on the 7 December, following on from my letter of the 30 November.

                  To clarify, the levy fees charged to the cases after the vehicle displaying the registraion XXXX XXX was levied have been reduced. This has resulted in the statutory visit fees of £42.50 being payable against each case only. I would like to confirm jowever that our enquiries lead us to believe the car in question is indeed owned by Miss D. Although, and notwithstanding this, and whilst we are legally entitled to do so, we will not be reapplying the charges.

                  Our position in this matter has not changed in that we will continue to pursue you for payment unless instructed otherwise by our client, despite your insistence that the matter be referred to the council.

                  All three cases are currently "live" for collection which could result in immediate enforcement action taking place, which could increase the cost element once again

                  Seperate statements will follow shortly

                  I trust the above clarifies matters.

                  Right... I know that they can only charge £24.50 for a first visit NOT £42.50 but to add it to all three cases when they've only ever turned up once and that was to collect on 1 account only. IS this legal? If not what can we do about it??
                  Also I will be emailing her today and pointing out AGAIN that my partner IS the registered keeper, but NOT the legal owner as they think (which I've told them already and even asked what proof thay want yet they just ignored me).

                  so what to do next guys???

                    Also received 2 more letters from Equita today. One of which is a FINAL NOTICE stating that the bailiff has been unable to contact us at our house and that we should contact they to arrange a time for them to come and take all our possessions (how stupid do these people think we are).

                    The bailiffs have NOT been anywhere near our house as my partners always in and I've been in lately due to and accident at work.

                        Ben, as far as I see it, nothing has changed here. You are paying the council direct and the bailiffs are trying to frighten you into paying them.

                        They lie; it's what they do, so just let them get on with their idle threats.

                          My only concern is that they will come and take the car as they've levied on it.
                          Without the car we're well n truly knackered n my dad will kill me!
                          Any advice regarding the car Amy?
                          As I've said in the past my dad went to his sol's to do a stat dec and they told him he couldnt do it its not his name on the log book. Is this true or are they just misinformed?

                            Their letter says they have removed the levy on the vehicle and they cannot remove the vehicle without it first being levied on.

                            As for the statutory declaration, the solicitor had to study law and qualify, so I would tend to believe what he says.

                              Their letter doesn't actually state that they've removed the levy though does it???

                              As for the statutory declaration, the solicitor had to study law and qualify, so I would tend to believe what he says.

                              I've since spoken to my father again and he said it was not his solicitor but his secratary that told him he couldnt do it

                                Just a quick update...

                                We have recieved a letter from the council stating that they are taking the case back from the bailiffs.

                                RESULT!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
