To stop you worrying so much: they can only take the driver to court in Scotland. You have had letters addressed to you but that's only because you are the registered keeper. If the "offence" was on railway land then that could also be a reason for the keeper not to be liable. The court case they reference was Beavis. This was for a free car park where the time was exceeded. Your car was in a paid car park therefore the cases are not similar and Beavis would not apply to you.
They are only certain of the keeper, they do not definitely know who the driver was, unless you told them.

Well i sort of panicked when they sent a photo of my car and in an appeal said i was just waiting to get my kids but m1 said just ignore them as well they have to prove it was me and they cant really my word against theres i suppose ....the thing i dnt get is how they can pick and choose to increase then decreaze the fines as they please like its a game

It was at a railway station car park at the back of station i had parked on the sunday week earlier dropping kids off went back 10 days later after 6.00pm on a tuesday to pick them up didnt get fine for sunday assumed the same for tuesday as i never left vechile and a person i dropped off said you dnt need a ticket shd be ok then i gt the fine

The picture they sent of my car shows me entering well my vechile and leaving but i left the car park drove around and came back it doesnt show that they have basically tried to say i was there the whole time waiting and i wasnt i even moved the car around spaces but i didnt realise you paid never parked here before....other parking outside train station doesnt grab gives you 20 mins i think so how can they do this

I have done 43 PCN's over about 7 years.None have come back.I stuffed Excel parking twice in a year in the same car park.PCN's are not fines.PPC's are nothing more than leeches who use scare tactics to part you with your hard earned money that they are not entitled to.(Not so)Smart parking do not do court.Neither do CPS Midlands, neither do AS Security,etc,etc.
If a PPC do not own the land then their losses are............NIL.
If a PPC do not have a contract with the land owner to enforce parking restrictions, then their losses are........NIL.
If a PPC operating a car park charge for parking,I.E. £2.00 per hour, and you over stay, then the losses of the landowner(not the PPC), are £2.00 for each hour (or part thereof) you overstay.
Since 1997 when I conducted my own county court case,i have had 2 county court wins, 2 out of court settlements, 2 speeding charges dropped, a bus lane contravention dropped,2 parking tickets dropped,43 PCN's sorted (number 44 in the post today),8(out of 8) issues with a local borough council won in my favour,2 PPI's successfully executed, loads of consumer issues sorted......the list goes on.and my success rate? 100%.I have not lost a case yet.And my proffession? A bus driver!
I have no legal standing whatsoever.I just see what laws have been broken, get the evidence, use the law and win.

Hi I have had my appeal rejected by MET parking services I sent the first letter M1 advised about giving ten days to sent me evidence and show losses which they said they don't need to but their response was after the 10 days and now they have sent me a letter with a popla code what is the next stage please

Omg your a working class hard working person like myself ive never dodged any parking in my life and it was a genuine oversight which i offered to settle at the time the cost of fee a £1.00 plus letter fees about £10.00 quid which i think is way too much wdnt entertain anything apart from 60-100-60'back upto 100-60 again and now 160 its a joke how they can actually get away with day light robbery if i took 60 quid off you in the street i would be arrested but dress it up with bows and it seems they can HOW IS IT ALLOWED

Well guys ive recieved another letter from debt collectors referring to there original letter dated 2dec that i got 14th and they wanted 160 quid by 16th dec what a joke 2 days notice anyway this one was dated 16th dec funny that same date they wanted mw to settle up on last letter so looks like they knew i wasnt going to must have a crystal ball .....this one is notice of intended court action for unpaid fine and again referring to there landmark case beavis and parking eye if i have not agreed a parking payment with them will be passed to a creditor and a recommendation to commence court action where i could be liable for all costs ....i couldnt afford there stupid fine so good luck trying to get the rest from me so guys looks like im heading for the cells lol

Have just recieved another letter from debt recovery on behalf of smart parking advising me that i can have the option of paying off the debt which has now gone from 60 - 100-80 now upto £160 i dont know which bit they dnt get as i advised i couldnt pay 80 60 or whatever they wanted but offered to pay the unpaid fee of £1.00
Plus cost of admin which is about 5 quid 10 at most.....they have advised i can pay in 3 monthly instalments before progressing to court ....this is starting to really effect my health as i have never had debt recovery letters for anything bit worried they will take me to court :-(
