Freind's HSBC debt sold to Marlin

  • Freind's HSBC debt sold to Marlin

    A big help is needed for a friend of mine who has today received a letter from HSBC advising that her HSBC credit card debt which is approx £2,800'ish has been passed to Marlin.

    I used to know what the procedure was but have been dealing with my own loan problem that it has all gone over my head.

    Quick background of her case is.....back in 2008 she got in to financial difficulty and started paying a reduced amount to Metropolitan Services...she did that for approx a year....then she stopped paying as she could not afford it anymore. I don't know the full in's and out's of the full history of the debt but she has asked me if I could help. She does not have access to a pc....so I said I would try and help.

    I have seen a copy of her DN which is bad.....but not sure if that is a good enough reason to just sit on and ignore any correspondence from Marlin.

    So what would the steps she would need to take? Would Marlin need to prove the debt was owed? or should they be contacted and see if they would accept an offer?

    Last time she paid on the debt was approx 2009 so I am not sure what advice to give and would appreciate any help on this please.

    I have attached the copies of the letters she received today.

    A bad DN would only come into play if this went to court. It wouldn't be enough to ensure no proceedings are issued so it wouldn't be wise just to ignore for that reason.

    If she hasn't paid since 2009, she's over half way through to statute barred, any offers would reset the clock so it wouldn't be a good idea to do that at this stage. :clock:

    So far she has only received a Notice of Assignment, but no demands or threats from Marlin yet. I would say she should just wait till she hears from them again, we don't want to be resetting the clock! :nono: When she gets another letter, do come back and post it up here.

      Oh thanks for that flaming parrot...........love the name.....and I agree that would be the best thing to do at this stage.....

      You have been most helpful....now I will have to explain this to my friend....which will be a mission in itself lol.....

        Flaming Parrot is a gorgeous tulip variety as shown on my avatar picture at the time I signed up I was also flaming (as in fuming :mad2 and dying to have a say so the name was most appropriate. It also has the same initials I was known by on another forum. :grin:


        Tell your friend not to worry, if they write again then she can send the Prove it letter, followed by a CCA request, etc. All in good time. I've got a bad Egg so I may also hear from Marlin one of these days, they've been buying lots of those too.

          Jumper999, hope you're well.

          I got two letters from Marlin today who've bought my HSBC credit card accounts. I'm going to reply to one of them straight away because it's a huge amount of money but no CCA (the account was closed in 1999 and a new one opened without new paperwork) so I might as well start the fight before they do :fencing:

          The other one can wait for the next letter from them since HSBC admits it's already failed the s.78 test

            These cretins seem to have purchased a job lot of Statute Barred and Unenforceable Debts recently. Must be an end of year sale.

              Hello, I have just received their newly printed standard template letters. One from the original lenders ( don't think so) telling me that they have sold the account and one from Marlin europe 1 ltd saying they now own it and have passed this one to marlin financial services ltd as their servicing agent to manage the account. Wondered why lowells was sniffing around my credit file leaving unrecorded entries. It does seem that they have bought a job lot recently.

                Both Marlin and Lowell have bought job lots recently. Lowell are devious bar stewards, they do their best to find out who would be a good candidate for a SD.

                  Just a little update...my friend today received another letter from Marlin Financial Services today saying:

                  We write further to our recent letter.

                  As you have been unable to agree a reasonable repayment plan for your above debt, your account will now be referred to our client's solicitors, Mortimer Clarke, to review and your file and determine whether our client should commence legal action against you.

                  To prevent such action, you must contact us to agree an acceptable repayment proposal within the next five days. This is a serious matter and you could incur costs on your account if legal action is taken against you.


                  I am not sure what to advise and any help will be great...thank you.

                      Tell your friend to send a s.78 CCA Request to Marlin asap. Mortimer Clarke (Marlin's in-house solicitors) don't hang about. The next thing she could get is a summons from Northampton County Court. MCL's idea of "reviewing a file" is to submit a claim via MCOL. Surely you haven't forgotten the horror story of Mrs G on another site :fear:

                          If you know she has a bad one is because she has a copy of it, otherwise how would she know? No, don't tell her to ask for a copy of the DN, most creditors will say they don't keep copies of DNs and Marlin certainly wouldn't have one, as they are debt purchasers not the original creditor. The DN only comes into play once court action starts, it's a card she should keep up her sleeve and not tell Marlin anything about it. :tape2:

                            Thanks FP.....I have seen her DN.....and I think it is bad.,.....I maybe wrong so will ask her if I can copy and scan it up here to make sure.

                            Plus she has sent off her cca request today and no mention of asking for a copy of the DN...thanks for your help.

                              I received a response today from Cabot about my littlewoods account. I sent them a cca request and they have advised me today that they are not able to provide me with the requested information and will refer it back to the original lender and in the meantime my account will remain on hold.

                              Lets hope my friend gets a similar response from Marlins.
