Re: Freind's HSBC debt sold to Marlin

My friend received this letter today from Marlins.....but they have not asked my friend to contact them and I am not sure what to reply.

Any help would be great. They sent statements where my friend has been paying £5 a month...last payment he made was on 16 Dec 2010....

Hi Jumper, I don't think it requires a response and your friend has to tough it out until it becomes statute barred.

I would be interested to know how long your friend had the card for.

They say they can take the case to court, but they admit they can't get a judgment. :confused2:

They have included that line as a bluff methinks. They are also wrong about being able to sell it on if there is a dispute but then again they are a DCA so the truth that they have bought an UNENFORCEABLE debt must annoy them

I've just seen this after having a bit of a break, that's an excellent result, just what your friend was looking for!

...and what everyone who sends out a CCA request hopes to receive: a dream response!

She should keep that letter in a very safe place, preferably a fireproof safe!

That's just a template-based, generic statement, you can tell by the reference to allocation of payments, etc. I presume she's not making any payments...
