Only thing that would concern me here, is youre giving cabot a free hit at you. By letting the Claim get stayed you are letting cabot have all the time in the world to get their house in order. Now that is a problem for me because they can go at their own pace, get the documents they should have had at the outset, and then come back apply to lift the stay and stick one right over you.
When you start a claim you are expected to have your house in order, its not something you should do after the event.
It is actually an abuse of the Court process to bring a claim with the intention of parking it in Court. So that leaves the claim open to a strike out application in my view.
