  • Hi I’m new with a Cabot Finance nightmare ongoing

    HELP

    my husband went bankrupt nov 2017
    news to me until recently
    he was forced into this by HMRC

    now I’ve received a CCJ stating Cabot Finance are going to take our house as he owes them £6000

    i had no idea this was going on, wrote to court asking for help informed them Cabot did drive by valuation and uundervalued our home by approx 60k stating it’s a family home, I’m bipolar, on benefits and need help.

    ive just received a letter saying court to go ahead in May when we are away

    i don’t know what to do, husband just keeps saying he will sort it and then buries his head in the sand

    im out of my mind with worry

    Firstly Hi and welcome. You have come to the right place for help.

    You say your husband has been burying his head, does this mean he received the original claim form and did nothing about it?

    Is the Judgement in both your names or just his? And the letter you have received to go to a hearing in May in joint or his sole name?

      Thanks for your swift
      the CCJ is in both our names against our home as mortgage is in both names
      all I have I a letter requesting we attend court as requested by Cabot Finance

        Did your husband get the clam pack and just ignore it? If he responded to the Claim pack then it's best to know. You say in the title this is ongoing, so how long has this been going on and what communication has there been from day 1 to now.

        Do you know what the debt is for as it was in both your names for them to get a Judgement in both names?

        Is the letter inviting you to a hearing for an Application for charging order on land?

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
