    You ask for a valid copy of the original agreement, together with the T&Cs that were applicable at the time. The importance of 6 April 2007 is that for agreements made after that date they can provide a cobbled-together version and don't have to supply a valid copy of the original. Luckily you fall into the earlier period where we can challenge anything that isn't a true copy of the original containing all the prescribed terms.

    Having said that, lenders generally tightened up their documentation when the bank charges movement kicked off in 2006 and they realised that they could get kicked in the plums by the likes of us, as happened from those early days. I suspect that for an early-2007 agreement they well be able to find the original paperwork, in which case the agreement can't be challenged. We should still be able to delay proceedings and challenge other things, particularly if we can get the SAR back and counterclaim for the charges.

    Letters are drafted now, will check them tomorrow for errors. Thank you to you both again for being very factual & giving me some help and hope.

    If they can provide a copy of the agreement then Ill be happy to challenge the other charges. The worst that can happen long term is I loose and have to make an arrangement on my zero income and hubbies zero disposable income. But whilst I have the opportunity I have to at least try and get rid/reduce the amount. :-)

      I'm interested in the status of the Claimant here, ME IV Ltd.

      They were only incorporated in 2010 and seem to be a venture capital firm rather than a DCA. They also have the same address as Mortimer Clark. Can anyone advise?

        Ok first things first. Who did you take the loan out with?. And due to your circumstances. You can use this to defend your case. Find all of the agreements with the company check all of the information stated. And get an SAR on the loan amount also contact the FOS regarding this. To be honest the debt has spiralled from what I've read and there trying to take yourself to court regarding the money that you took out for the loan. Kati briscoe myself and loads of people from the site will help you so dont panic. Do you have any credit cards past or now or any overdraft fees etc that need looking into also take care and speak to you soon.

                If it's your debt, then they shouldn't expect your hubby to pay for it - so they'd have to accept an arrangement on your zero income TBH :lol:

                  OK its one of the many guises of Marlin Europe. Just interested why they don't say that.

                  At least this confirms that its owned by a DCA so that will help us stall for time while the SAR is being dealt with.

                      Hi Sloane82,

                      It was with Black Horse Finance. Ive drafted the SAR, CCA & CPR ready for sending tomorrow. I will wait for the details they provide then definitely contact the FOS as I hold no details anymore. The payments I were making via the CCCS up until the beginning of 2012 were going directly to CCCS so I can't even find the reference's on old bank statements. I can't be sure but I'm convinced there was PPI on this loan whether that makes a difference or not as if the interest accrued is part due to that then Im hoping it may be greatly reduced (at the time I was employed by a Large Internation Organisation, had a final salary pension, death in service, sickness benefit & critical illness cover with that so Im really not sure I would have even needed it) So if I did have it I will be using that too.

                      Yes there probably are other debts floating around I couldn't tell you how much to be exact, I was paying everything via the CCCS from 2009 until early 2012. Things just got awful and I lost my head for a while after the loosing of my daughter, then when I got pregnant in 2011 I was taken into a specialist unit for the majority of the pregnancy due to illness, my employer made my life hell in every way possible, they really didn't care as they were shutting up shop to move back to Dubai (unbeknown to me), so when I finally had some fight in me and a very good case I was knocked straight back down again after being told that I could still pursue a claim but it would be costly as the company was now out of UK jurisdiction, I was gutted I had worked for them for over 8 years and been a model employee despite loosing my daughter. I took solace in my immediate family and shut off everything outside including debts. Ive moved around quite a lot due to OH job so I expect they've had a real job catching up with me but it seems they have..... I assume this now will be the flood gates for anything else thats on its way. I have nothing to give them until I return to work in 4 years when OH returns to civvies street and we are settled somewhere.

                              Morning Guys, Im off to to get the postal orders this morning and post everything off by registered mail, just the quick question of the payee...? Would assume making them payable to the actual company name i.e BHF for the SAR and ME IV LTD for the CCA request? Its just Ive read that some get returned due to wrong payee so would I be safer leaving them blank for them to fill out?

                              Any advice gratefully recieved x

                                Each postal order needs to be made payable to the company you are sending it to ... they are more likely to send them back if they are left blank :tinysmile_twink_t2:
