Thank you again guys really appreciate all the direction I'm getting from here. Although now I'm addicted to the site and can't stop reading things every chance I get Hubby thinks I'm crazy!

It can get very addictive and it's certainly empowering to be able to fight back with the banks.
Just be careful he doesn't become a soon-to-be- ex hubby :colbert:

I totally agree, a very empowering feeling, I know so much more than I did a week ago and its not as daunting as I first imagined (yet anyway).....I told him Im gaining knowledge for free and I'm no longer nagging him about it so he should be happy

Hi All,

Today I received a letter from Mortimer Clarke Solicitors:

"Further to your letter dated XX/XX/XXXX, we are taking our clients instructions in relation to your request and will come back to you as soon as we can.

We confirm our client is willing to agree to the extension of 28 days, for you to file your defence. Pursuant to CPR 15.5(2) please notify the court in writing of the agreement."

Then they sign off.

Im assuming this is good news and saves me having to ask them to agree an extension?

I will photocopy the letter and send a copy to the court on Monday with a covering letter.

Any further advice would be gratefully received as always.

Indeed that is good and saves you an extra job Yes, send to the court with a covering note, you can do it by email if it's easier.

Great news as long as you have that in writing and it suggests that they are struggling to get the paperwork. Get the notification and the copy letter to the court asap and then that adds a further 28 days for your defence-due date. I think you sent SAR as well - am I right or thinking of a different thread? If you sent that then it means we should have all those details before you submit the defence which should help a lot.

Im hoping that now the extension has been agreed the SAR will be back in time which will hopefully help.

I will scan in the letter from MC and email the court tonight (much better idea Amethyst :tinysmile_grin_t: ) at least then I know its done. Then it will just be a case of waiting and seeing what they all come back with in way of my requests. xx

I hope you're all well. Just a quick question, should I chase the CPR & CCA even though they've acknowledged receipt of my request?

Still haven't heard anything further, no docs and no SAR yet but I know that can take 40 days.

Ive done some more reading on the site and it appears that some people are eager to chase up the CCA/CPR and others are not.

Im assuming it would be favourable to chase as something else to put in the defence?

Hi,

If they have acknowledged receipt then you should be fine, when you get to a few days before the defence is due in, you should ask the solicitors to agree to an extension under CPR 15.5 to allow them time to find the documents.

A little update......

I did send reminders last week as was unsure. The court have confirmed receipt of a copy of the letter from MC agreeing the extension and confirmed via email however I called the NCCBC in order to confirm the the new defence date would be the 22nd December 2014 and the are saying that its still the 24th November, I explained about the email and that Ive had a confirmation email back from the court and the lady couldn't be more unhelpful and rude.

Im sticking with 22nd December but will aim to get my defence in by the 18/19th because of the weekend etc. I have confirmation from the court by email from a clerk saying the extension had been noted, despite the rude lady, so Id say having it in writing is safer than listening to her.

Still yet to get any documents back at all from anyone.

SAR is request 40 days is up on the 5th December (with 2 days grace for postal service)
No CPR or CCA yet.
