    Good afternoon All,

    Just about to acknowledge the claim online, all other letters have been sent to the relevant people with postal orders.

    If I click 'Defend in Full' when acknowledging can I later change the if I need to (pending the responses to CCA , CPR & SAR).

      Defend in full and see what they can come up with as evidence to justify the claim.

          Hi All, Posties just been. Had a reply from the current owner Marlin to say they have requested a statement of account along with a copy of the agreement from the original creditor. Its also says that my account is now being dealt with mortimer solicitors and that all future correspondence should be directed there.

          They've attached a statement from what looks to be like their system, and stepchange/cccs payments looks like they were being sent to them and according to their records ceased in February 2012, Monthly interest was then applied.

          Does this mean that I shouldn't defend in full? As they were clearly receiving payments from me?

          Any advice grateful received x

            They will still need to supply you with a copy of the agreement and terms under the CCA, so hang fire.

              Defend in full because we still don't know what they can produce. If they produce a valid copy of the agreement then basically that can't be challenged, but there are other things to consider as well and they still have to comply fully with your CCA and CPR requests and we're a long way off seeing that yet.

              If the date of service was only 21st then you still have 33 days from then before the defence deadline comes. If they still haven't complied fully with the CCA and CPR requests by then we can ask for an extension of up to 28 days more too. What I'm hoping is that there are delays until we get the SAR stuff back and that will tell us whether they can enforce and whether they comply. It'll also show us what charges have been added on so even if they can enforce this at least we can counterclaim for the charges to reduce the amount.

              That's all in the future so its a waiting game now.

                Thank You Amethyst & Kafka,

                They show 3 interest amount applied after the last payment from CCCs of:

                £60.70 - 3/4/12
                £59.47 - 3/5/12
                £62.23 - 01/06/12

                I would expect there was interest before and after that added on which might be why the amount is so high.

                Just to be sure, the SAR has a 40 day time and the CCA (7 days) & CPR have 12 working days....? (just so I can make a date in my diary to chase. x

                  CPR - 7 days

                  CCA 12+2 days ( so 14 days)

                  SAR - 40 days


                  Your important date is the DEFENCE DUE date so keep an eye on that one, as we'll need to either put in a defence or ask the otherside to agree an extension a few days before then.

                    Sorry Kafka, it's 33 days from DATE OF ISSUE (as printed on the claim form) - 28 days from date of service. They allow 5 days for service, so it is safer to go off the Date of Issue.

                            The key thing is that you must get something in the court by that date and preferably a day or two before in case there are any hiccups. Ideally that would be the full defence, but that can only be done properly once they have complied with all of your requests. If they haven't done that by that time then you can ask them to agree an extension and notify the court. If they refuse that then the best option is usually to submit a holding defence, which fulfills your obligation to submit, while stating that you still can't supply a full defence because they haven't yet complied fully with their obligations.
