    I'm in two minds whether to apply to amend or not following this receipt of documents, I'll talk to someone tomorrow. The documents aren't fully compliant but they are 'fixable' (in that they need to type them out and reconstruct the additional terms) and as you are in fast track you have a costs risk so if the chance of success is too slim then we might need to start thinking about a negotiation while we still have some strengths on our side. We could try and get a Tomlin order for installments to keep you out of a CCJ.... but let me check on the position with that agreement copy. If we continue then we will need to amend the defence so would have to tick the 'intend to apply for application' on the N181. The N181 has to be in by 20th doesn't it.

    Their N181 asked for stay 1 month in order to provide documents, so you could just agree to that to give yourself a bit more thinking / negotiating time.

    This is the bit when the 'game of chess' gets a little more complicated. Just so you know I am thinking about your case and am concious of the timescales.

      i havent seen any documents or fully read the thread but i can say that i agree wholeheartedly with amethyst on the cost implications where a claim is allocated to the fast track.

      i am speaking from first hand experience when i say the costs can be in the thousands

            Also, as you are in fast track, you might want to try and have a chat with our Paul Tilley at Howlett Clarke Solicitors about your case. He is up to his eyes in work at the moment though, just by way of a warning, so he might not be able to take it on but even if he can't take it on he might be able to give you a more hardline approach and idea of the risks than I'd be able to. http://www.qualitysolicitors.com/how...le/paul-tilley

                Yes all received. Sorry I thought they'd sent you their N181 not an email to agree directions, so you should get their N181 before the 20th then, and we can just tick agreed directions on our N181.

                Reply to Shoosmiths telling them you agree with the directions, and the stay of one month, and thanking them for the documents they have sent to date.

                Don't be tempted to go into anything else about the case.

                              Hi We'll a reply has been received by email acknowledging my acceptance of the stay and I have been requested to put forward my offers of settlement

                                Ok I sent a message advising that before I can consider an offer of settlement I would need to see a notice of assignment

                                1 week on I am waiting an acknowledgement

                                Am I in a position to negotiate or has this gone too far
