          Thank you so much I have just this minute received an email from Shoosmiths with their directions questionnaire which mentions they are requesting a 1 month stay in order to obtain the documents requested

          I am not sure how they have my email perhaps from the courts as they emailed my defence back to me

          I take it I can email my DQ back to Shoosmiths if this is how they want to communicate

          Do I need to attach copies of any supporting correspondence

            Yes you can email the DQ to Shoosmiths.

            You can just agree with their directions if they are straightforward, month stay, disclosure 14 days before hearing etc.

                Hi just taken my lunch and have re read the email received today attached are copies of the agreement and application, a credit card statement and default notice
                they note they are awaiting the notice of assignment which they claim was sent 2o December 11

                I am assuming this changes things with regards to my defence

                        Got them thank you, will have a look in a little bit as kids about to get in from school - on first glance, the terms look illegible and seem incomplete - are those exactly as you received them?

                        If so we should be okay but we will need to do some amending of the defence and hang fire on the N181 for a day or two.

                          Hi apart from my personal details being removed it is as received,not the greatest of copies although at a strain you probably could make out what the CCA is saying I guess I could request a copy to be sent by post as we have a month stay

                          Do I still have time my defence needs to be received by Monday 20th

                            Okay, put the N181 in but in the bit where it says have you made any applications - put that you are making an application to amend your defence.

                            Then we'll have to go through everything to date and work out whether you are actually continuing defending or making an offer to pay.

                            In the terms part of the copy agreement it refers to terms which aren't included - being 3.5 and 3.6 - they need to send you the full terms - so that's in your favour

                            The default notice looks okay - they give 14 days to rectify.

                            There's no notice of assignment.
