I never acknowledged letter before claim now I've recieved claim form

    Yes I thought as much. It's the waiting game time now so let's see what comes up.

    Honestly just through the help and support I've recieved so far has made me feel so much at ease. Wish I could buy you all a drink or two. Who knows

          Do I need to send more info to obtain recordings etc. I wouldn't know what date from up to what date to.

            You probably want the information from around the time your account started to go pear shaped, defaulted and closed up to now. Did you communicate with them by phone or by email - maybe complaining about charges/interest - telling them of a change in circumstances etc ?

            Documents wise you want account opening, screen notes ( anything directly related to the overdraft ), as well as documents from account default and closure and assignment to any third party. You don't require full transaction lists probably only the six months prior to default.

              Thanks for response. I think I have an old Experian/Equifax report around. I'll check if I still have it. As far as I remember it should show default date. It was around 2012 as far as memory serves me.

              Any correspondence would've been by phone call.
              I'll send back the form as well as a separate sheet requesting what you listed above.

                Today I called up the court to ask the status of the claim to which I was told it is "Stayed"

                I did recieve back a massive sar request folder from the bank. Having a skin through, I found opening and closure date closure beginning 2013.

                A copy of the current account statements.
                it looks like I made a last payment of £1 mid 2015 so no statute barred I dont think.

                There is information noted about the debt bring sold as entries in screen notes but no solid letters regarding this. Appears it was sold several times . I cannot find notice of Assignment or a credit agreement.

                Do I just wait now ?

                  One other thing. When I sent off for a sar request, I didnt enclose the £1 fee. Do they send any documents separately out of interest.

                    There is no fee for a SAR and if you mean the CCA, if they wanted the fee they'd have wrote back to you denying the request on the grounds of no fee paid.

                      This might not seem it, but is good news as they probably won't be able to provide notices of assignment from all assignors along the chain.

                      The alleged debt is an overdraft, so wouldn't have a credit agreement.

                        Thanks for response. Ok yes it may be good news. I'll wait and see. If I sit and wait, how long before I can take any next steps if any and ask for case to be closed if that's even possible ?

                          You could apply to lift the stay, have the claimants statement of case truck out as having no real prospect of success and the claim dismissed at a cost of £255, but if they successfully defend the application an order may be made to go to a hearing and you may be liable for their costs of defending the application as well.

                              Just an update. Too date, I have not heard anything back. Still a stayed claim at present. We shall see.
