Hi all,

please can you advise, my anxiety is through the roof. I received a claim form this morning giving me 14 days to reply to a total claim of £2329.48 for a catalogue and argos card. Having read the back I agree but wish more time to pay. It says I need to fill the N9A and send it back in within 14 days. My question is I’m single with 1 dependent and struggling to survive on a single wage, would it matter if I only offered £10 a month? Also will I still get a CCJ if I don’t pay it all? Thankyou

If you admit all the debt and are sure it is not statute barred, you should complete form N9A and send it to the claimant

Please read the article "Admitting a County Court Money Claim" at Shelter England.

You will have to include on the form all your savings, income, loans etc and then either state a date when you will pay in full or make an offer of monthly installments

You should also file a copy of the form with the court

If the claimant does not accept your offer, court staff can decide how much you should pay

Try not to worry,

What you should do is fill in an income and expenditure form, take into account the 'cost of living' i.e. energy, food etc.
Give yourself a 'buffer', if prices go up. A Court will only ask you to pay what you can afford, if it's £1 a month so be it.
This isn't a priority debt. See if they are willing to reduce interest and charges. Explain your personal circumstances.

personally i'd defend it. you can get an extra year and you may be able to find something that invalides their claim. worst case is you end up paying an extra £300 but you get about a year from now to deal with it.

chances are solicitors will do a WPSATC at some point aswell for about 50% of the debt. they will have bought it for £0.01 for every £1 of debt.

No, it means that the paperwork may not be compliant, they may of made errors regarding default notice, letters of assignment.

You are defending it to make sure things were done correctly, just because they did things, doesn't mean they've done them correctly.

Do I not send the N9A form back then? What should I do..sorry for sounding stupid but no idea what to do. I’m conscious that I only have till the 14th to get the paperwork back to them

a) First Acknowledge Service of the Claim, you can do this online via MCOL, this will give you 28 days from the issue date (plus 5 days postal) in total to work on your defence.

b) Send a SAR request to Grattan, Freemans, home retail group, they have 30 days to provide all the data they hold on the account. Make sure you get Proof of Postage.

c) Send a CCA request to Lowell portfolio they have 12 days to provide a copy of the original agreement. Make sure you get Proof of Postage. - You've done this.

d) Send a CPR 31.14 request to Overdales Solicitors they have 7 days to provide all the documents they are relying on to make the claim against you, again get Proof of Postage. - You've done this.

Don't speak to creditors, solicitors etc over the phone, everything in writing. Keep on top of this, especially dates for filing defence etc. Workout when your Defence is due, 28 days from the date on the claim form. If you can post on the thread 4 days before it's due we can help with your Defence.

Yes, makes sense.

The SAR to Grattan and Freemans isn't necessary for your Defence, but might help, if there are anomalies, which you could raise in your Witness Statement further down the line.

to be clear, you do not wait for their reply. You file your defence before the deadline, regardless of whether they reply.

Does that include CPR 31.14 I send to the solicitors? If they don’t reply do I carry on with my defence?
