        Re: Help with RLP

I'm not sure they will have anything although they may have a letter from the court ? I really don't know how magistrates court works with notification.

A copy of that letter has already been sent to RLP and CCL I believe? and RLP responded with that letter stating they'd carry on anyway, and that threats/abuse against their staff wouldn't be tolerated ( but obviously it's okay for them to do it to consumers)

I'm just going to do an FOI request for court claims bought by RLP or CCL over the last year..... although they will probably come up 0 as the retailer brings the claim don't they.

                This is just ridiculous

we agreed to place the matter on hold pending the outcome of criminal proceedings.

That hold period has now ended. We now require your settlement proposals

                  Re: Help with RLP

RLP are a mickey mouse outfit with no justification or authority to demand anything, even under tort.

Their letters are best used for hamster bedding as that is all they are good for

If it was me i would say "Take me to court"

I would then hit them with a wasted costs order

                    Re: Help with RLP

So I can't take them to court for their non ending harassment
I will write a letter later this evening will post it here before sending it on Monday morning on my way to work
However I am still waiting for Debenhams customer service investigation to take place and maybe hopefully they can tell they can call off this harassment
Can I point out that every time I send a letter to Debenhams a couple of days later I get a letter from RLP sometimes I feel like they want to scare me and cause me stress and make me to stop requesting my stuff back

I'll have to look into/ask around about you taking them to court ... but if they carry on harassing you then (IMO) it's gotta be worth a try  xx

                        Re: Help with RLP

You can take Debenhams to court and RLP as co- defendants

Debenhams are ultimately responsible for the actions of RLP

You will need specialist advice. Try and get a solicitor on a Pro-Bono basis

Use this as your source material on harrassment from a commercial company

                          Re: Help with RLP

If you were to take them (either Debenhams OR rlp) to court for harassment, you would have to prove without a doubt that they were actually harassing you first

Your next step would be an injunction.

If they still didn't stop, you could then proceed with a court case against them

That is why specialist advice in this area of litigation is a must or you will find yourself on the end of a wasted cost order

                              Re: Help with RLP

Just come in and found this new thread.
It's unbelievable, but I really think the best course of action is to continue ignoring RLP.
We know there business is based on threats and the use of pressure, especially on those they see a vulnerable.
We know from past experience that if you respond in any way to their idle threats they redouble their efforts.
If you quote case history, they only come back with other spurious case law and legalese gibberish.
RLP don't do court after they lost against defendants who admitted shop lifting. They are not going to try against someone found not guilty (this isn't even a Scottish non proven verdict!)

Please continue to ignore their letters.
I am trying to appreciate how difficult it must be for you, but that really is the best course.

Separately, if the police don't have your goods, write an LBA to Debenhams, telling them if they do not return them you'll be seeing them in court!

                                Re: Help with RLP

                                good evening everyone
I have wrote the letter using some of your brilliant information you provided. You guys are awesome I read all the case study's and I found them interesting. so here is the draft of my letter tell what you all think. I had to use the Arkellv. Pressdram (1971) only because I really wanted to tell them to f..k off but thought this will be a professional way to do it if you know what l mean

                                To whom it mayconcern;
I acknowledge yourletter of 18/10/15 referring to myself. I will no longer communicate with youover this matter. Your client Debenhams and you (RLP limited) have accused meof shoplifting in January 2015 which I denied to this date and disputed thematter and went to court which I was found not guilty. The information thatyour client had provided on the statement turned out to be false and they couldnot provide justifiable explanation of the accusation against me.In your letteryou write with regards to my co-defendant pleading guilty, I fail to understandwhat that has to do with me. She pleaded guilty of what she did wrong and wouldlike to remind you of the judgement of A Retailer v Ms B and Ms K. OxfordCounty Court 26/27 May 2012, you have no ground legally to harass peoplewithout providing the proof of the expenses you are requesting on how you incurreda loss or how the staff where diverted from their usual posts and if thesecurity guards were on duty they sure didn’t get paid extra for doing the workthey are paid for.I proved to thecriminal court that your clients statement was false and won my case and foryour company and your client to state in the letter that you stand by youraccounts unfortunately your accounts didn’t stand in court with three Judges andthey are certainly not good enough for me. Please do provide justifiable and foreseeableproof before you accuse me of shoplifting, and harassment that you have clearlycontinued to do despite the court’s decision. You have caused me distress and youraccusations are clearly and highly defamatory.I am fully awareyou are not a civil court to make such judgements as you please with yourclients and have no right to accuse me of a crime I have been acquitted of andshould you require civil proceedings please do so in a legal lawful manner in alegal civil court rather than harassing me in my own home as this is not goingto be tolerated as I have explained to you in numerous times in my telephoneconversations with all your customer advisers. My response to your spurious claimfor damages under tort will be governed by the response given in: Arkell v.Pressdram (1971).Please beadvised that if you continue to further harass me with unsubstantiated mattercausing me distress and discomfort brought by your letters with continuous maliciousaccusations and requesting money for the items that are legal and genuinelymine I will seek legal advice to sue you for the damages caused by you, whichcould have been avoided if this harassment had not taken place under TheConsumer Protection (Amendment) Regulations 2014.
