    Latest news on CR. My local trading standards has deferred everything to Swansea Trading Standards (where CR is based) as they are undertaking on ongoing criminal investigation into CR. Also, MOJ rang me today and asked for copies of all correspondence between ourselves and CR. Things seem to be moving hopefully. Will keepyou informed.

        Having just returned from our 5 birthday Legal Beagle meeting in York and after discussions with one of our members, some of my fears about how the CMC's are able to oporate without having to have insurance indemnity to cover in the event that they go broke etc... she has given me a great insight into what further action needs to be taken and this is something which I will be mentioning to the MOJ as this has bothered me for ages and especially after Cartel went down owing millions+ a few others would this be a detturent.

        Not only will this be mentioned to the MOJ at our meeting, but this will also be taken up with certain MP's which she is going to provide me with details and which I will work towards making a safer place for people to pay the CMC's upfront with the knowledge that they would be indemnified in case of the CMC going broke.

        I just wonder how many CMC's will be able to afford this type of insurance?

        Will the MOJ, include this as making this a condition as part of their authorisation to be able to trade?.

          I have been involved with Consortium Reclaim for nearly a year, they cold called me, encouraged me to transfer all my credit onto a virgin credit card on which I owed nothing and took £1300 10 minutes after I put the phone down. I was promised I had nothing to lose that within a month I would be told whether to keep paying my lender or not or I would get a refund. I had a welcome e-mail the next day I tried to cancel but was told of the very high success rate they had and talked into staying. I have heard very little from them since and always get fobbed off when I ring them. My minimum payments soared and it has cost me £1600 in interest so far. Apparently the people they use Credit Clear Services have been taken over and this in one reason for delay. (Yeah right) I have sent them a recorded delivery letter of complaint as per the MOJ's advice had a letter back saying they would respond in 5 days. I rang my designated complaints handler yesterday as had heard nothing and he pointed out that my details were passed onto CR from elsewhere possibly a survey I had taken part in and the MOJ accepted this as not cold calling and as I had an e-mail the following day this counted as pre-contract information as set out by rule 11 by the MOJ. Problem is they look into breaches of contract and they seem to have theirs watertight and poor naive people like me over a barrel. I am going to contact my lender and talk to them about this section 74 see if I can get some money back. What are the chances ? I hate the idea of being cold called but apparently thats ok if a third party has given your details is this right? I shall never be nice and take a phone survey ever again!

            As part of your T&C's with Consortium is the money which you paid all £1300 fully refundable if they have been unable to make a claim for you? I had a member who paid a huge sum to another CMC, they were unable to make any reclaims for her despite them taking £2800 from her credit card some 15 months earlier, with my help she got them to agree to refund which took 14 days and then a further 26 days before she received payment. So please consider the T & C's as this is extremely important.

            The chances of you ever getting a refund on section 74 for this is very remote and in a dodgy area of law you should be writing to Consortium either by email or by special delivery and request the return of your money which they have taken as it has been nearly a year ago since they took the money and have not advised on how your claim is progressing. You may also advise them that is you do not get a full refund you will going to the Trading Standards and pass a complaint on to them. I believe more and more people are doing this now and this will then motivate the MOJ to act on these cases.

            Also, reading the MOJ report which came out in April it says a lot of complaints come via the MP's which they act on, so here is another route for you to contact your MP and make an appointment to speak about this and how your were duped into parting with all this money.

            What do you think your credit card provider is going to say, yes we comply with section 74?

            Also, have you read Jenni's post, Trading Standards are already looking at Consortium - so get in quickly.

                They assure me my £1300 is fully refundable. Don't want to do the section 74 thing anyway but I might ring my cc company and explain the situation. I am at the moment accusing Consortium of breach of contract as they have never sent me pre contract info before taking up front fees they say they sent me an e-mail but it was only a welcome one with no real info on it. They sent me a copy of a totally different e-mail with pre-contract info last Thursday? And I have demanded they listen and let me have a copy of the original phone call, appently they are going to ring me today. Yes got to get this sorted quickly, will do the MP thing next and Citizens Advice. Thanks

                            At the moment, we are finally getting results. We were advised by MOJ and Trading Standards to claim back the fees using Section 75. We sent detailed letters and copies of correspondence to the credit card companies that CR used for the fees. We have, to date, received a full refund from two of the credit card companies and have three to go! Both companies who have refunded the fees stress that they are going to chase CR for the money and hopefully in the future they will not deal with this company again. Untimately, as explained by the MOJ, they will be turned down by the majority credit card companies when they try to claim their fees and then their business will have to fold - that is unless the MOJ revokes their licence first, which is a strong possibility. Sorry for the delay in updates, but it has been a long hard slog. Will keep you informed whether the other credit card companies refund.

                              Well done Jenni that is great news hun.

                              I really cannot understand why the MOJ have not yet closed down Consortium Reclaim. But great news that you have managed to get some satisfaction and have started to get your monies back.

                              Here is a lesson for everyone that deals with a company from a cold call and parts with a sum of money on the promises of getting rich rewards.

                              There are many genuine companies out there that will do the work and recover monies then take their fee from the proceeds - mind you I would not be able to recomend any Claims Management Company as it is quite simple to reclaim Credit Card charges and PPI yourself. One of our members received a credit card refund in full within 9 days and the total refund was his to keep.
