    Statutory Demands used to be able to be issued if the debt was £750 or more and they can be issued without lodging it with the Court.

    For many years Stat demands were personally served on a debtor as a scare tactic, even when the creditor had no intention of taking the debtor to Court because the Court fee was often more than the debt.

    Realising this, the Courts changed the rules so now before issuing a Stat Demand the debt has to be £5000 or more.

        Got it. Yes others have had the same kind of thing from AJJB Law. So it sounds like Allay haven't sold the debt to CRS which is good.

        Another member here got a formal letter before action from AJJB law but their 'debt' was £1500 whereas yours is not so much.

        Let me know if you get one.

            Wonder if someone could assist me too please. I had a letter from CRS demanding payment to something I wasn’t even aware had been awarded. Filled in forms for Allay years ago, not heard a sausage, then got some forms asking me to complete, that they would be passing my case over to someone else to deal with and they acknowledged passed on. In meantime I got demanding letter from CRS informing me I should have received a letter from HSBC stating I had a claim. First I heard. HBSc won’t talk and I keep calling to have a claim put on hold. Any advice would be fab. Am gonna fill in paperwork for ombudsman and my MP to sort out mess. Not happy bunny but certainly not paying for something I haven’t had.

              Can you clarify this? Are you saying that Allay referred a PPI claim to another claims management company? If so who?

              Once that's established you need to make a formal complaint to Allay.

                      Hiya

                      I got the letter of claim.

                      As I said previously I think there's a fair chance that they're sending you this to intimidate you into paying and they don't have any real intention to issue proceedings. However the form is part of the pre-action protocol process and you must respond to it.

                      So fill out the details on the reply form (name, address etc), ONLY tick Box D and where it asks why you dispute the debt put ''I did not give the claimant my informed consent to provide me with any claims management services as per my formal complaint to them of 3rd September 2020''.

                      That's it.

                              Was that in response to the Reply Form you sent back?

                              If so it only goes to indicate that they're not serious about issuing proceedings and were just trying it on.

                              I would simply respond as follows:


                              Dears Sirs

                              I can only refer you to Box D of the Reply Form which, for ease of reference, is ''I did not give the claimant my informed consent to provide me with any claims management services as per my formal complaint to them of 3rd September 2020''.

                              I trust the above is clear enough.
